  • Bw legals recent letter (this week) is offering for me to pay it and I won’t receive a CCJ. So should I pay? Or is it too late?

    Basically, that I never received a letter of claim or any original letters. The machine wasn’t working on this day in question and there are no contact numbers on the car park site to call and pay over the phone. 
    I have used this car park since and experienced the same issue with my card and my mothers hsbc card, but her Barclays card worked. Which is odd. 
    Unfortunately, I had to collect a present for my son whose dad just passed away. My priority was him as we were being made homeless in the January due to his fathers death. My younger two children were too young to acknowledge the death of their father. 
    You didn't stop to read and use our Template Defence (top of the forum) which is why I said "oh dear".

    The above isn't a strong defence yet you were posting on a forum that gave you a strong one.  Too late now.

    I am trying to call the courts now. I can’t afford a ccj with my mortgage and 3 children 😭

    Why are you trying to call the court? 

    Stop. You have put a defence in. It's weak. But it's in.  No reason to phone anyone.  Please slow down.

    You aren't getting a CCJ.

    Stop looking at this forum on a phone if you are finding it hard to navigate.

    However: I'm using a phone and it's dead easy to hop about.  A cinch.  And my signature even tells you where the link to page one is.  And yes it's right there on a phone.

    Did BWLegal actually say ... pay and you won't get a CCJ ??  Would love to see such a letter

    BWLegal are not gods, they don't know what will happen in court  ... only a judge can issue a CCJ ..... County Court Judgmement and not some legal

    Even it does go to court, and even if your defence is not up to par, you have a second bite of the cherry and it's called a crib sheet which means you write down on paper what you want to say to a judge face to face
    You have a story to tell

    Most Judges are sick to death with these parking cases yet they do need input from you so they can apply the correct decision

    BWLegal offering a deal more often than not means they don't want to go to court.  If they really thought they would win, why make an offer ???

    YOU CANNOT get a CCJ unless you lost and did not pay within the time period given by the Judge

    How much will you pay if you lost ?  Because BWLegal has added a fake amount and signed a statement of truth about the fake, if you lost, most judges will deduct the fake and interest so you would end up paying up to £200 .... AND NO CCJ. END OF STORY

    If you win, and your story will help you win, you can claim costs against BWL

    Stick to your guns, all BWLegal can do now is send a rent by the hour legal, most are useless .... and that's another point ... Judges do not approve of useless legals
    You certainly do not pay a bribe from BWLegal
  • This is the letter I received from BW legal. 

    Thank you for taking the time to respond and help. I got the letter and went straight into panic mode and didn’t know what to do

    At least it alerted you to the fact you hadn't put a defence in at all.  That letter saved you. A weak defence is better than a CCJ.

    And now you have weeks to read the first 12 steps in the Template Defence thread and get ready for each stage.

    Defence is not your only job.

    Read the NEWBIES thread second post about witness statements and don't write your own, nor miss it.
