    Do the AOS stage ASAP because you are more than 5 days after the issue date from the top right of the claim form

    With an issue date of 06/05/26 and providing you complete(d) the AoS after 11/05/26 and before or on 25/05/26 your defence deadline date is 4.00 p.m. on 08/06/26

    Is there any benefit to leaving the Defence till closer to the deadline date or just get it done as soon as?

    seem to remember there isn't but just wanted to clarify.

    Its entirely your choice, but dont leave it to the last minute, preferably not the last day either, in case MCOL has a problem

    AoS done. If there is no benefit to be gained by delaying the defence ,I may swell just get on with it then as I am way next week

    Hi

    Have had a read through @meltof defence and can understand how it all fits except for para 3. Not sure if para 3 is suitable for my situation and would like some advice please.

    I tried to overturn the case through Popla at the time as I didn't know better ( bit better informed now). I'm sure that I said I was driving though as I had to pull into the carpark as I was looking for somewhere to pull in and change a flat tyre. While I was looking for somewhere safe as the roads were really narrow ,my young son started vomiting and gagging/choking. I had gone from the Midlands to Devon to pick him up as he was on holiday with his grandparents and fell ill while away. So was already stressed out. Just coincided with going past this carpark and I just panicked and pulled in quickly.

    Didn't even look for signs etc as I had more important things going on.

    My wife attended to my child and I changed the tyre and we were gone in 30 mins .

    Basically ,the situation I found myself in caused me to stop in the car park and not notice anything about payments or times etc.

    If I remember rightly ,Popla also stated that I had stated I tried to make payment which just didn't happen.

    I will also add that it was quite late in the evening and the carp park was completely empty( understand that this is irrelevant )

    So my question is: As I understand it , PoFA wouldn't be relevant in my case as such.

    So do I just leave para 3 out of the defence as written by @meltof and copy the rest?

    Your advice would be much appreciated so I can get it sorted

    No just copy the whole Meltof defence because nobody will read it and DCB Legal have no idea of your appeal.

    This is a numbers game.

    They always discontinue these Smart ones before hearings so get it in and (apart from later filling in the DQ as per the 8 steps) twiddle your thumbs until you get the NoD in the Autumn!
