  • Thanks again Eddddy - rang the freeholder again and queried when he sent the pack he said as soon as he got the payment, last week and it is in the post.  It is still possible he's confused - don't know. 

    If I'm a cash buyer and there is a likely big delay is it possible to buy the house without the management pack and is there some kind of indemnity available for such scenarios?

    Yep - you can buy without an LPE1, but you have to just take the risk. There wouldn't be any kind of indemnity insurance you could take out.

    (And your solicitor might want you to sign a disclaimer saying that you are proceeding against their advice.)


    But it could get super-messy if you did that. For example, the LPE1 might say that the freeholder believes that the service charge and/or ground rent is in arrears.

    If the arrears aren't paid, the freeholder probably won't register you as the new owner, and might refuse to discuss the arears with you (as you're not registered as the owner), and then start proceedings to forfeit the lease (i.e. repossess the flat) because of the arrears.



  • Thanks Eddddy - hard to believe there are people out there that would be that unreasonable but yeah I suppose they exist.

    It's a house and not a flat btw don't know if that makes any difference.  But yes ok sounds like there are big unknown risks.  If there is no indemnity then looking like it's not an option.

    It’s not then being unreasonable but protecting their interests. There are a lot of quirks of leasehold law and if they don’t protect their interest they and other leaseholders could lose out.

    That is before you get into any GDPR/data protection issues on arrears of another individual.

    Your best bet for accommodation is further lodgings as the flexibility of notice cuts both ways.  Try looking on spareroom.

    Thanks already tried Airbnb - only very pricey stuff at the moment
    Have you checked by entering a date range? I only ask as I offer 30% discount for over three weeks but that will only show up if you select the date range otherwise you will just see the daily rate.

  • I might be cracking up here but just heard today that letters with stamps with the queen's head on would be treated as insufficient postage.

    Just wondering if the freeholder posted lpe1 form to sellers solicitor with an old stamp on would solicitor just return it or pay the postage.  Could explain why it's still missing.

    Lpe1 form still not arrived over a week now and all I get is I'm sure it will arrive soon.
