LPE1 form and lodgings

I'm waiting for a LPE1 form from the freeholder on a leasehold house I'm buying.  I sold my house 3 month ago and a friend said I could lodge with her while I found another house.  I'm a cash buyer so no mortgage involved.

The landlady is wanting me out, she's not given me a date but mentioned 20th October and vague about any extension.  I've not done anything wrong pay my rent, pretty quiet I think she just wants her house back to herself.

Any suggestions for temporary accommodation most want a minimum of 6 months and I can't commit for any longer than a month or so.

Also could I ring the freeholder, I have his number, and ask him for a timeframe or would that be overstepping the process.

  • What was the contractual agreement (verbal or written) beween you and your LL?

    Lodgers have few rights (assuming England) other than contractual, and a common law right to 'reasonable' notice where there is no contractual agreement.

    It depends on the freeholder. Many would refuse to speak to you, as you are not their leaseholder.

    Perhaps the more usual route is for you to chase the seller - saying that your solicitor is waiting for the LPE1 and it's holding things up. And ask the seller to chase their freeholder.

    I rang the freeholder this morning - he said he sent the LPE1 form back "some time ago".  I've rung my solicitors this morning to tell them this - said they'll ring sellers solicitors and ring me back.

    Sellers solicitor email said "We made payment for this 05/10 but the pack has not been received as of yet." (Management pack/LPE1 form).

    Freeholder said:  "Sent it back some time ago"

    So if the freeholder says he sent it and sellers solicitor said they haven't got it - well what next?

    Your solicitor suggests that the seller's solicitor need to chase for it. It's either been sent by post and not arrived, or it's been sent by email and overlooked. if it genuinely has been sent, the freeholder will confirm the date it was sent, the seller's solicitor will double check, and then if it has gone astray, they will arrange for it to be re-sent.

    So there's a disagreement between the seller's solicitor and the seller's freeholder.

    The seller might be the best person to take this forward - as they can contact both parties directly. (For example, you can't phone the seller's solicitor, but the seller can.)


    But...
    • The freeholder won't do the LPE1 until their fee is paid
    • The seller's solicitor says they paid the fee on 5/10 (last Thursday)
    • Most freeholders don't turn around LPE1s in 3 or 4 working days
    • And the freeholder says they sent the LPE1 back "some time ago" - does 1 or 2 (or 3 or 4) working days count as "some time ago" 

    Based on the very limited info - I'd guess the freeholder is confused, and talking about a different LPE1 for somebody else.
