Ninja cooking pot gone wrong Argos and Ninja won't help or honour warranty

Bumble Jumble just for information Argos keep telling me I need to contact Ninja And that warranty/ Guarantee is with Ninja.
So I'm confused as to who is right. Surely they supply there goods to Argos for Argos to sell, so they are In directly supplying me something. Please correct me if I'm wrong.
Who is correct are Argos correct that warranty/ guarantee is with Ninja and that there for ninja need to sort it or is warranty/ guarantee with Argos and they need to sort it

The 2 year manufacturer's guarantee is with Ninja. That gives you what Ninja's T&Cs say it is, no more and no less.
If you have an Argos guarantee such as Argos Monthly Care, that is with Argos and the terms (eg what is and what is not covered) are what Argos say they are. It is underwritten by D&G but your contract is with Argos.
Separately, and quite differently, you also have statutory rights under various pieces of Consumer legislation. These are against Argos, not Ninja, and what you are entitled to is determined by law, not by Argos's T&Cs.
Your statutory rights cannot be taken away by any warranties. Warranties are in addition to your statutory rights.
Argos probably use Ninja to actually carry out some of their obligations under consumer rights, which can cause issues, but the duty remains with Argos to provide your statutory rights.
Guarantees can sometimes give you a better outcome than your legal rights.

You have no Statutory rights with Ninja
You have a warranty with Ninja whereby they can dictate the terms and they have decided only to offer phone support and they are fully entitled to do so.
Therefore you should go back to Argos
( my point above was that you can ignore any comments about what the situation would have been if you had bought the unit from Ninjas website as it is not relevant )
I would not engage with Ninja any more
To avoid getting into another loop I would send a very polite email or letter to the CEO of Argos and ask for their help
Apologise for troubling them but advise that Argos customer services keep telling you to deal with Ninja who are unwilling to assist.
This should get passed down to the executive complaints team who hopefully will resolve

I just thought I would give a update, I emailed the CEO of Argos but didn't hold out much hope.
I was very surprised to get a response within 24 hrs appologising prefusly for how I had been treated and offering to sort out a replacement straight away.
I didn't ask for a replacement I was happy for it to be repaired all I wanted was a working pot.
I'll take a replacement pot though.
Argos are meant to be delivering replacement pot today some time this afternoon and collecting old pot, we will see if they turn up.
My only worry is I don't have original box and packaging for pot I have that I'm returning. As have had it 6 months and didn't have the space to keep box as it was massive. I got rid of box after a month.
I have packaged it in a different box, will Argos delivery driver accept my pot thats faulty that I'm returning in a different box and different packaging. Everything that came with it is there just not original box. Or will they refuse.
I guess I could un package it and put in box new one comes in if driver not happy.
Am I over thinking things.
Will they accept it without original box and packaging.

Just received replacement pot and they took away my old pot no problem.
But I'm a little worried. On opening outer box of replacement pot, it was clear too see that this pot had been opened before. The inner box was open and inside packaging for rack that comes with it was open and rack was loose. Envelope that contains manuals was ripped. There was no protective plastic cover on plug, and pot inside was slightly dirty.
Most of the film was still on the pot and tape, I'm wondering if it's another customer return. Maybe a customer opened it decided it was to big so put it back in box and returned it, I don't know.
Is it normal for them to send out a Customer return or used pot as a replacement.
I'm hoping it wasn't returned due to a fault. I have plugged it in and it turns on will have to test in a bit to see if it's fully working.
Before I do test it, should I accept a clearly opened item as a replacement or should I be saying something. Will my warranty still be valid if replacement is a customer return opened.
I am greatful to get a replacement pot and as long as it works and doesn't have same errors and can use it I'll be happy.
Just most concerned as to if my warranty and insurance after warranty expires will still be valid.
Any advice much appreciated

Strictly, the replacement you are entitled to is a pot which has had 6 months use but is in perfect working order for its age and use.
A brand new and unused pot would have been betterment.
If you check your warranty you will find that it runs from the date when you bought the faulty pot in April, regardless of how many replacements you get.1 -

Why don't you e-mail the Chief Executive again and thank him or her for their intervention and say that you have received a replacement but that it has clearly been used and seek his or her reassurance that your original warranty and insurance are still valid. They may replace your replacement with a new pot, but even if they don't they should reply and confirm your warranty and insurance are valid and then if you have any problems with either in the future you can produce their reply to you.
