car warranty and breakdown

Please help I am desperate.

I purchased a car on 28 April 2023 and aid outright (inheritance from my mum recently passing) paid £10,500.00 and £1000.00 extra for 3 years RAC warranty. 
On the 25 September my car broke down and was told not to drive it as a serious fault (wet belt as a Ford) and needs looking at. I thought well that's ok I have my warranty. I have had nothing but problems and am still at no resolution. RAC are trying to say driver damage that I knew of the fault and should of not drove it (no engine management light came on till I broke down)

Anyway they are sending a assessor out. My question is, if they wont pay (looking at over £3k) can i pursue the garage I purchased it from? It was a big successful garage near me

    The answer is you might be but don't delay letting the garage know as faults that develop in the first six months are deemed to have existed at the time of purchase.

    There are others who will explain this in far better detail that I can but certainly i suspect you have a chance.

    The other one has been closed, so this is the "live" thread now. (TBH this is a Consumer Rights issue so the other one should have probably remained. It has further details re. the car, age etc.).

    I think this statement needs further clarification:

    What exactly does that mean? Did the breakdown happen on the 25-Sep and the engine management light came on at that time, and that was your first indication/knowledge of any issue? Did you proceed to drive the car after someone (the RAC?) told you not to drive it? Why are the RAC supposedly making a categoric statement of driver error?

  • Apologies, my other thread I did because it’s a separate query, yes with the same car.

    the engine management light only first came on on the 25 September and I was told not to drive my vehicle so I didn’t and it has been towed to home and to the garage since, so how the warranty people can say driver error is beyond me as there was no indication prior to the breakdown of any fault. 

    I incorrectly assumed that as purchased a warranty that it was them I needed to go to which now I know I could of gone straight to the garage I purchased from due to how quick the fault/breakdown happened after purchase. I’ve since found out that the warranty provider are notorious for claiming driver damage to not pay out. They are doing everything to delay the repair and when challenged are coming up with a new reason/excuse
