Britannia Parking Group Limited Parking Charge Notice (PCN)

Hey,

I'm looking for some advise.

I got a letter suggesting I did not validate my cars reg in the carpark of a pub I was in.

I didn't get a letter until weeks after the event as they sent it to an old address (forgot to change the address on my car). I finally got a letter once a legal firm was chasing the fine (still not my address though but my parents, to which I have never lived)

I'm pretty sure I did validate (not 100%). However, they sent me a letter asking for £170.

I contacted them via online chat and said, "I did validate my parking and I have proof I was using the pub and not just parking there and not using the facilities". I sent them a redacted version of a bank statement showing a purchase at said pub on said day.

Their reply:
"Further to the query you raised with us, Our Client have confirmed the vehicle should have been registered at the bar, as per the signage in the car park. They are satisfied that this Parking Charge Notice (PCN) was issued correctly. Our Client have offered a settlement of £100 to close this matter.
We trust this now concludes any outstanding queries you had raised with us."

What would you suggest I do now? Ignore or pay? I feel that I shouldn't pay.

Any advice is appreciated.

Don't pay but do read the Newbies/FAQ thread where everything you need to know is laid out for you.

If you pay, you are marked as low-hanging fruit on the gullible tree.

Following your use of the 'online chat', it looks like the parking company now know the driver's identity.

Have you now corrected your vehicle's Registration Document? Can be easily don online.

Following on from what @B789 wrote, a complaint to the pub (Plan A) is in order; if they want to keep you and your friends and family as customers, they should make sure the PCN is cancelled, the obviously faulty registration device should be repaired and the PPC should be kicked out. Pubs don't need them unless they are intent on driving away all their customers and closing down!

Obviously no paying!  These are a cinch to win by defending, and usually without a hearing as they give up.

You could reply and ask why they have ignored your statement that you DID VALIDATE AT THE BAR and under the pre-action protocol you wish to invoke your right to documents, namely the VRM validation list from that day, with all other recognisable VRMs covered, leaving visible only unmatched or partial VRMs,  This is required now, in order to demonstrate if the allegation is a keying error (minor typo) or not.  Give them 30 days to supply this under the PAP.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

...... and also ask why THEIR system allowed a mistake to be made (if indeed it was) by trying to register a VRM that wan't in the car park!

"On line chat" with a scammer is another way of pulling you into their slimy trap do not fall for it it's like a phone call which we don't advise, but they will have stored it now on their system.
The bank details should shared with the pub, the PPC won't be interested.
  • Thank you all for your replies.

I will not contact them again.

I told them I validated. I showed them proof I was a consumer at the pub. That should be enough.

Plus there is no cost at this cark park for customers.

I will update if I get anything else.

No, you really should do as advised.  At the moment you don't know if there was a keying error.

The duty upon parties to resolve disputes is part of the PAP and as a party to a potential court claim, you should be engaging and asking for disclosure under the PAP.

Using the words we gave you.

Upon your suggestion I have commented back.

"Like I mentioned in our online chat, I did validate my parking at the bar.

    Many thanks"

Again thank you for the advise.
  • Update:

Heard nothing from them since the above response was made. Perhaps as they did not get a quick payment they have given up? Been well over 30 days.
