I must agree with B789. As long as you are sure it is a penalty notice. Don't be afraid to tell these low life legals the facts and if it means telling them to stick it up where the sun don't shine .. do it, there is nothing the fools can do
What you probably don't know is that QDR are an offshoot of the shamed Wright Hassall solicitors, yup, the name says it all. The BPA employed Wright Hassall as a POPLA
What a disaster that was and now QDR are heading the same way.

Yes I deleted the reply as you said its a penalty notice then a PCN
So you reply thus
You tell them they are out of time. The county court has no jurisdiction in this matter and if they try and issue a claim under contract to provide case law to show they can do this (it wont exist) and do a SAR to saba
Then you defend (imho) on this issue alone if you get a claim (that's its timed out as it was a summary issue only) Again look for case law on summary issues. Look for any appeals "by way of case stated" in the high court in relation to this matter
QDR/zzps have claimed in the past they can go from penalty to pcn and a court has agreed with them.
Get the SAR in immediately
You don't want any other issues clouding this defence4 -
Also worth quoting the BPA CoP Appendix on Railway Byelaws cases that I think says operators must make the basis clear under which the charge is issued. Can't later morph into contract law if the parking space was offered under byelaws and the remedy for contravention was issued as a Penalty Notice.

As a bad offshoot of Wright Hassall who are family solicitors, Wright Hassall should cull QDR FROM BEING INCOLVED IN PARKING SCAMS
