Ebay is not the law, they can tell you not to send it back or to dispose of it but legally thats not their advice to give, basically what they are saying is do what you want with it with no basis in law for them to do that. This is why they are no longer interested in your case.

Legally you become an involuntary bailee as already mentioned. Also as above said there is a process you need to go through none of which is just donating it to charity. Disposing it is a last resort.

You can write to them asking them to collect their goods, give them two weeks, or send a working label at no cost to you, email will do it doesn't have to be hand written. You can claim reasonable storage costs from them once the deadline passes. You can then sell it at auction, you cant just sell it for a fiver to a pal, then send them the proceeds less any costs.

Just to update on this as requested: the seller's claim was thrown out of court when I actually attended. I even offered to settle the full cost of the bag out of court, which he rejected as he pretended he should be paid at the level of a solicitor for the case and would only settle for £3000. Anyway, in the event, he got nothing. Thank you to the people who were helpful and constructive here.
Thanks for coming back to update us OP, fantastic to hear the seller didn't get a penny :)

He got less than nothing. He'll be out over £60 plus any travel costs. Also worth noting that this took over five months to get to a hearing.
You're nicer than me offering to settle on the bag cost.
