No SAR; no longer in the NEWBIES advice. Better for a claim to arrive with no SAR.

It's not 'unfortunate' to get a LBC. I'm helping another Brighton local who is a month ahead of you.  Told him to do what the NEWBIES thread LBC stage says.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I'm reading I don't need to fill in there forms etc. I will open a new email just for their correspondence.

    Can I follow these instructions?

"Yep, non-POFA.  You have a perfect defence.  This will be simple to defend if you get a claim.

But why not send DCB Ltd and CEL a robust 'cancel the PCN' email telling them that you were not driving, and that you are only the registered keeper of the vehicle, with no legal liability.

    Then add:

I am not obliged to identify the driver and I decline to do so.  The PCN is not effective to transfer liability to myself (the keeper) because it does not comply with the conditions for a notice to keeper in Schedule 4 to the Protection of Freedoms Act 2012 ("POFA").

I require you to cancel the PCN and erase my data.

If you persist in processing and/or sharing my data and in the event of CEL filing a court claim, take note that I will file a Part 20 counterclaim for not less than £500.  This will be claimed as damages for distress arising as a result of clear breaches of the DPA 2018 and/or the Protection From Harassment Act 1997.

I will rely upon the case of Simon Clay v Civil Enforcement Ltd and similar cases that have succeeded.  Cancel the PCN and crawl back under your respective stones forthwith.

    Is it a non-POFA NTK?

Please show us the front & back with your own data & VRM and PCN covered, but NOT covering up any of the dates.

  • My fault I have no idea what I'm talking about-I just searched 'LBC reply example'. Nothing to do with POFA. Apologies:(

But those are not the exact keywords the NEWBIES thread coaches to search for. And obviously you must search for NEWEST (from 2023) not old 'best match' results.

Or you can just ignore it.

Wait for a court claim (might never come) and if it does, use our Template Defence.

No risk. We win, sleep easy. This is NOTHING.

But you have left a VRM and PCN Reference showing on the "Parking Charge Notice Payment Slip" so you should remove that back page image & crop/cover it at the bottom.

     :)

Thanks. I know you are the expert and I should not take up more of your valuable time:)  I am being informed I must not ignore this 'letter of claim'. I must reply within 30 days?

Are you stating I am safe to ignore the LBC until I get a court letter?

I am more than happy to do this but need to be assured and I don't want it to harm my defence.

    Thank you :)

Plenty do ignore LBCs, then successfully defend claims, but on balance I prefer to see a robust response to dispute it. As per the NEWBIES thread!
