    Good.

Another Inquiry - as vital as the other one I showed you in September but separate, and this is going to the Justice Committee.

Very relevant for you.  As you are experiencing a 'scam' parking claim and the unwelcome burden it places on you and our court system, this will be right up your street to do this weekend, please:

Please take a moment to provide your evidence about delays to this Justice Committee Inquiry:
    https://committees.parliament.uk/work/7972/work-of-the-county-court/

    CLOSES IN A FEW DAYS.

    NEXT THURSDAY!

PLEASE SAY THIS, IN YOUR OWN WORDS:

The parking industry should be required to adhere to a proper 'parking pre-action protocol' designed to keep cases out of court and agreed to by the DLUHC who are regulating the parking industry.

These generic roboclaims churn through the system, clogging up court time over meritless rip-off PCNs.  The bulk litigators are making a mint and filling the court service with rubbish cases that waste Judges' time.

The Justice Committee are inviting evidence, not rants or bare opinion, so we need people like you to respond, who are currently caught up in a PPC claim, and can attach evidence and tell the Justice Committee that you didn't want to go to court but have no choice, because the PAP for Debt Claims the industry frighten people with, isn't fit for purpose for handling disputed parking charges fairly.

Show them your threatogram letters and Claim Form and tell them about the delays you are experiencing so far, and how much precious time you've wasted on it.

  • Thanks for sharing this with me! I'll definitely take a closer look at the inquiry this weekend and provide my evidence.

Facing a bit of a dilemma here. Got an offer from PE to settle the claim at £70, down from the original £205.

I've been handling this claim for my sister, who's not too keen on the stress of a hearing and is leaning towards taking the offer. But I'm torn and thought I'd get some advice before making a decision.

On one hand, it could feel like a small win and a quick relief from the hassle. Yet, I'm concerned about setting a bad precedent unless this is standard behavior for them. Any thoughts?

Ask them by email (their email address is in the 2nd post of the NEWBIES thread) what this further info is; sounds like your landowner complaint has worked:
    Efforts to resolve:
    • Reached out to Starbucks store manager seeking assistance in canceling the charge.
    • Manager seemed unsure due to it being at the court stage.
    • Awaiting response after the request.

    She could ask that question:

"what is the new evidence, is it that Starbucks want this cancelled, if so why not damn well  cancel, then?"

...and maybe to resolve it this year, offer £20 (marked 'without prejudice save as to costs' and the Claim Number on the email subject line).

I would not offer more.  You don't have to offer anything and certainly not if this applies:

Is the driver/passenger elderly or disabled?
If they are, add that fact and state in the email that they needed more time and are covered by the Equality Act 2010 (attach the blue badge if held).

By the way the Justice Committee Inquiry has been extended by a week. CLOSES ON 22ND (next week).

  • I'm not entirely certain if the landowner complaint directly prompted this settlement offer. After my conversation with the store manager, they mentioned emailing me PE's response, but I didn't receive any follow-up. However, I can't pinpoint any other reason for the offer, so it's plausible it might have been due to their intervention. Interestingly, the settlement offer letter coincides with the date I sent them my DQ N180.

I'll reach out to PE to seek clarity on this 'further information' and offer a settlement of £20.

  • YES, you must ask PE what the further information is if they refuse, then ask the BPA

PE must share the information and to the court ....
What will they tell a judge ?  THIS MAKES THEIR CLAIM FALSE

It's been almost a week since I emailed PE with my query and counter offer, but I haven't received any response yet. Is this delay typical for them? I noticed their auto response mentioned it could take up to 10 working days for a reply. I'm thinking the holiday period might be contributing to the delay as well.

Today marks the deadline for accepting their offer before it expires. Any suggestions on how to proceed at this point?

Do nothing.  They are likely to discontinue.

  • Just a quick update regarding our parking charge case. Unfortunately, my sister has decided to settle and pay the reduced amount of £70 to put an end to this ordeal. It's not the outcome we were hoping for, but it's definitely better than the original demand.

I wanted to take a moment to express my gratitude for all the advice and support you've provided throughout this process. Your contributions have been invaluable in getting us this far.

Thank you all so much for everything.
