You are drip feeding information and your story has changed part thread, this is why we are confused.
Could the explanation be that you are entitled to (and TUI agreed to) your denied boarding claim from TOM4273 and this is to be processed. What you are not entitled to is delay compensation under EU261 as you were not on TOM4273.
No because the flight landed just a shade under 1.5 hours late anyway
So even if he was on it he wouldn't. All this is is a clear case of miscommunication and confusion.
I’m with you . I was thinking if they filled in the wrong claim form and TOM4273 was neither delayed long enough or the OP wasn’t on it, TUI would deny the claim and that was the response from the airline.
I have further investigated, we were offloaded for Operational Reasons. Contacted TUI store (never knew that existed). They agreed it is totally confusing and were embarrassed about the lack of direct phone communication to the "after travel team". Told me to come in later this week and my claim will be escalated. Also confirmed I am entitled to involuntary declined boarding plus any additional expenses that I incurred. Hope this helps others, be persistent even when you are declined repeatedly.
