Denied boarding compensation??

    Yes I misread, it's far too hot. The flight was not "cancelled" though as per the opening post. 

    Anyway, the advice is generally as posted. You have to convince TUI 2 days along the line the ATC issues no longer applied. Exhaust TUI complains procedure and if deadlocked go to AviationADR.

    You have said that you were denied boarding.  And then you have said that you were offloaded which would imply that you were allow to board but then were asked to leave.  Can you be clearer please?

    I was told I was offloaded by TUI. They said on 2 separate occasions I was entitled to Denied Boarding Compensation because of this issue. 

     I incorrectly assumed the flight had been cancelled I have clarified I was offloaded.
     
    I have never, ever said I was denied boarding. I have said repeatedly that TUI says this qualifies for Denied Boarding Comoensation, which they have now cast into  doubt.

    My original question stands if anyone has real knowledge of this am I entitled to EC261/2004 or not? Which applies as £350 per person because of the flight distance and delay.

    I have never claimed anything contradictory, thanks for your time. I think I can spend mine better elsewhere.

    I think you are right, and that 'elsewhere' might be the Flight delay compensation sub-board in the Overseas holidays & travel planning section.   ;)

    And I already answered you. You have to convince TUI that the offloading was NOT as a result of the ATC issues 2 days before, exhaust their complaints procedure, and then go to AviationADR.

    Usually when I use forums like this, people with experience of the issue get involved. 

    Barrack room lawyers with their own opinions help no-one.
    As I asked politely repeatedly if you have experience of this issue please respond.....

    Otherwise uninformed opinions are pointless.

    You are drip feeding information and your story has changed part thread, this is why we are confused.

    Could the explanation be that you are entitled to (and TUI agreed to) your denied boarding claim from TOM4273 and this is to be processed.  What you are not entitled to is delay compensation under EU261 as you were not on TOM4273.

    No because the flight landed just a shade under 1.5 hours late anyway
