Loft conversion/lease issue

    he says he’s never come across this before
    But I have been to the local council explaining the situation with the planning permission documents (I have a copy)
    Filled in some forms paid and they will send the building  regulations  certificate and another document they have 

    it could take a few days or it could take up to 10 days
    my seller should have done this my seller should have had all the documents 
    I won’t be buying if this doesn’t work with my mortgage lender
    My solicitor has advised me not to  in any event
    unless this is dealt with
    he tells me that my seller would not be able to sell this as a 3 bed and the price would be sufficiently reduced 
    unless it’s a cash buyer and they still would be reluctant unless she drppped 50k

  • Apologies if I have missed this upthread, but what does the title plan for the flat show? Does it show the loft conversion or not?

    I had an issue when trying to sell my flat where the buyer's solicitors raised something similar - not clear in lease that the conversion was demised to the flat. But we referred them to the title plan, where the conversion was clearly shown and outlined and that was enough to reassure them.

    I’ve unfortunately gone on from there 
    the lease was ok and accepted 
    The problem now is no building regulations sign off 
    have applied to local building control filled in the forms and have just got to wait until 
    we hear from then 
    mortage lender will only accept the above or a regularisation certificate 
    or to sign an undertaking that I do not use the loft conversion as a bedroom 
    the seller want to negotiate and sell as two bed with a loft room 
    I am asking my mortgage lender how that would work 
    at this point I am just looking at my options 
    any input would be great
