    Just wanted to check if my paragraph 3 is any good?

    3. The Driver entered the car park as a customer of the retail park but did not see any signs relating to time restrictions. The driver had used the retail park on occasions before and had never been aware of any time limits or see any signs thereof.

    Another question - can I use paragraphs 5/6 & 7 re POC breaches if I’ve already received copies of the two letters and blurry pics from UKPC in my SAR just last week?

    Yes you can because the SAR isn't the POC.

    And your para 3 is OK but why aren't you admitting to driving in para 2 like the template defence says to do?  Which of course then means in para 3, you say 'the Defendant did this/that' not 'the driver'...

    Unless you weren't driving and have truthfully denied it, rather than admitting driving, in para 2?  Do one or the other.

    The driver did not see any prohibitive signage. The driver stayed on site and did not leave the retail park site. On finding that there was a 3 hour 0 minutes restriction on parking at the site, was shocked.

    The defendant was not the driver so will deny that fully in paragraph 2

    (Basically the Defendant knows who the Driver was but has never disclosed)

    So what? You are under no legal obligation to reveal the identity of the driver. This is not a criminal matter. It is a civil contract matter and you are dealing with an unregulated private parking company.

    So just making sure that the above defence template is the one I should be using? I know! I’ve just seen so many confused threads that’s it making me question my sanity.
