First PCN, orignal never reached me so no chance to appeal

Hi all,
First time poster. The advice and shares on the thread have been really interesting. I have read through the NEWBIES post but not found (or potentially missed) the answer I was looking for. I wanted to get some advice, any help would be appreciated.

I recieved a letter from UKPS Limited saying my car had overstayed at a restaurant a month earlier. The parking limit is 2 hours and my car was there for 2hrs 20mins, according to the CCTV images when I log in to the site. Apparently I had not responded to a PCN and had therefore missed my chance to appeal or pay £60 so now I have to pay £100.

I wrote an email back saying I had not recieved any PCN letter so was not given the chance to pay the lower amount, appeal or get advice. They have replied saying I can pay the £60 within 3 working days.

My intention is to write back and say that the email does not constitute the same as a PCN and that I should be given 21 days to investigate the claim, pay or appeal.

Is it legal to not give someone the chance to appeal? I was wondering if there was any advice on how proceed or if I should do anything differerently?

    Also apologies for the two threads. I didn't realise MSE made a second one for me. If its possible for Admin to just delete this one that would be good

    Just let it slide, with no further response on it.  It will then slip down the forum list into oblivion, with so many new posts each day, it will be on page 101 (and beyond) soonest! 🙂

    Just a quick update: I have recieved a letter from 'Debt Recovery Plus' asking for £160

    As per Newbies thread, I'll just ignore it.

    I wanted to double check if I had followed the advice correctly so far? The only correspondance I've made to UKPS is that I never recieved the initial PCN. I did not reply to their offer to pay the £60.

    Yes you have, but there is something BIG that we need you to use that letter for, and make a (recorded on another phone) call to DRPlus please, as explained in the link below.

    REALLY IMPORTANT THIS MONTH:

    Please please (please) do this and give the Government your evidence - the frightening £170 demand - and tell them how receiving extortionate 3 figure threats and the thought of having to defend a court claim feels, because DR Plus don't listen to reason.

    Less than 3 weeks left till the evidence call closes.  It's one email from you. One question; will take minutes.

    Make sure you attach letters to provide evidence. And a recorded phone call to DRPlus to expose what they REALLY say to consumers.

    Obviously state at the start of your email response to the DLUHC that you are a consumer and are answering Question 4.

    The added imaginary £70 on top of an already very high penalty (for doing nothing wrong) makes people less likely to settle the matter and of course, more likely Gladstones will litigate.

    It is not something you wanted to happen but you did not pay the unfair PCN and will now see the parking firm in court, because the way the PCN is ever-increasing looks like a scam.  This business and bulk litigation adding £70 should surely be illegal once the rogue industry is regulated.

    Change the law... we already are...
