But show us your POC first if you are trying a DIY job. You have to plead the case based on a legal basis.
Read CPR 16 about what must be included in a statement of case. Show us and we'll look.
Bear in mind we are not lawyers.
You could ask David (he posts as bargepole here) how much he'd charge to do it for you, properly:
https://smallclaimsadvisor.co.uk/I have no connection but have worked with David in a previous company many years ago. Now with his new firm, he writes Claims and submissions all the time. AND is one of this Country's (rare) top private parking law experts. He has succeeded in claims just like yours.
You will not hand it to anyone better and more likely to get you some money. He might even suggest a punt for four figures.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I'm going to write some POC and also speak to David if I can get in touch.
Will post the POC here.
Is there any way I can delay them hitting me first on the 14th of this month. If not i'll just have to move quickly and submit mine before they can.0 -
Methinks you are in need of some education as to what "PoC" are. They are not something you write but what the claimant, or their solicitor if they're using one, put on the N1 claim form that states their case against you.Anto_28 said:I'm going to write some POC and also speak to David if I can get in touch.

ie me as the Claimant would write them.
I served mine separately last year as they didn't fit in the MCOL website.1 -
So, are you are counterclaiming or initiating a separate claim of your own?0

As Coupon-mad correctly points out, if we claim, we can request default judgement at the click of a button if they fail to AoS or file a defence in time. Can't do that with a counterclaim1 -
post up your POC , ensure to include your cause of action2

Delay their claim by saying you are seeking debt advice and they must put the case on hold for 30 days (under the pre-action protocol for debt claims). DO NOT REMIND THEM ABOUT YOUR LBC.
They can't do the same to you (delay your claim) as they aren't an individual.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

As this nasty outfit they will ask for proof of this, unlike any other parking firm. They seem to think they are above pre action protocolCoupon-mad said:Delay their claim by saying you are seeking debt advice and they must put the case on hold for 30 days (under the pre-action protocol for debt claims). Yes saw that in another thread. Still - that's what the OP should do.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
