    The matter has progressed and I now have a court date for April.
    Additionally the Claimant has stated that 'the defendant seeks to defend the claim on the basis of a generic defence found on the internet which is either outdated, inaccurate or not relevant to the facts of the case, It is highly doubtful the Defendant understands the complexities of the case ..' It also goes on to state 'Defendant who fails to deal with an allegation shall be taken to admit the allegation. The defence should be struck out as it fails to disclose any reasonable grounds for defending age Claim and Judgement should be entered in favour of the claimant.'

    Any advise will be much appreciated.

    Unfortunately looks like I missed that cutoff to share evidence with court and claimant - it had a Feb date. I hadn't received any evidence from the Claimant either. Just received something by post this week with these details.
    Given I had not submitted any evidence, do I still have any standing.
    Also from an evidence perspective, appears like I was there that day and parked, I have evidence of payment as well - but it did not cover the full time. Hence unsure as to how to proceed and evidence.

    You must do it now.  Monday by email to the local court and the other side's solicitors.

    But you said it was a double dip?

  • Initially did seem like a double dip case as I had entered and exited the parking lot 3 times that day and the second letter showed a 5:03 time, which I read as time of exit. But reviewing thru evidence pack now, it was the time of letter generation. 
    The specific evidence they are sharing relates only to the first exit, where I appear to have over stayed. 
    Problem is I used the app only for the first payment and used the physical meter for the remaining parking and hence have nothing to show as evidence of payment. 
    I can share the details, but at this point wondering if it is even worth fighting this further and also taking a day off to go to court. 
    I would still like to dispute the charge of £100 and then £170 for overstaying a few minutes - but is that even a topic of argument. 
    Do I have any case here or better paying and moving on?
    Any advise will be appreciated.

    If you miss the hearing you will be treated as acting unreasonably, will lose the case and will be clobbered with their legal rep's travel & fee, meaning you'll get an Order to pay £500 or more.

    IF YOU DO THE WS (AND ATTEND) YOU CAN'T BE HELD AS UNREASONABLE.

    Polite nudge:

    just do the WS bundle today.

    When I said this (below) I meant it. Takes half an hour, maybe an hour to add your evidence you do have.  Just make yourself go get one of our exemplar WS now...you can do this!

  • Looks like they also missed the cut-off date, but yes I received their evidence by post last week.
