    Did you file your Defence before 4pm today?
  • Hi, Thank you for all the advise, I had filed the Defence in time and got a letter from the court acknowledging my submission and stating they are awaiting a response from the Claimant and things had gone quiet.

    This week, I received a Letter which was a 'Notice of Proposed Allocation to the Small Claims Track', asking for a confirmation on proceeding with this approach and to fill out the N180 questionnaire.
    What is the best course of action now?
    I need to respond and then start working on my defence and witnesses.
    Do I read out to the claimant requesting all relevant information ?

    Any advise will be appreciated

    You were expecting that weren't you?
    Your best course of action now is to go back to that checklist you were following when you filed a Defence.
    Items 8, 9 and 10 on that list explain exactly what you need to be doing now.

    But you won't be 'starting work on your Defence'. That was filed weeks ago.

    The second post of the NEWBIES thread offers good guidance on the process. Treat that as your bible.

    3. You must by 23 Oct 2023 complete the Small Claims Directions Questionnaire (Form N180) and file it with the court office and serve copies on all other parties

    Assuming the 'all other parties, would relate to the claimant as well, which in this case would be UK Car Park Management Ltd - is this not required and should I limit my response to the court ?

    Sorry, wrong assumption.

    If you were to look again at your Claim Form, you will see that there is a box headed Address for sending documents and payments (if different).

    That box has the address for Gladstones Solicitors Ltd in it.
    UK Car Park Management Ltd has contracted Gladstones to deal with this on their behalf.

    So you need an email address for Gladstones. 
    Every one of Gladstones' webpages has this on it...
