  • "I'm also trying to prevent beratement about getting it wrong again."

    Per Google:-

What is an example of beratement?

"He didn't just correct the cashier who gave him the wrong change — he started to berate her, calling her names in front of the whole store." When you berate someone, you do more than just raise your voice at them; berate implies putting someone down by insulting their character."

I can not see any posts (including mine) that remotely include anything like the meaning of that word. All I see are words like "welcome", "please" and wise words from posters drawing your attention to your errors.

We sincerely hope that you are au fait with the need to respond to the private parking draft Impact Assessment by mid-September?  They did release the draft Impact Assessment ten days ago and it has some useful analysis.

I am not au fait unfortunately. I have zero idea. please can you direct me.
    Direct you?? I don't understand.

Why not just follow the link in the post you are responding to?
Skip to the first page of that linked thread and follow the links in the opening post for all the information you are likely to need.
Thanks for responding. I followed the link and it went straight to page 6 which is an appeal for photos. I didn't realise its not all about the photo appeal.
I am doing my best to get the correct information and there's loads on here.
I'm also trying to prevent beratement about getting it wrong again.

Page 6 is not an appeal.  There are no appeals on that thread.  Page 6 is a good place to start in an otherwise daunting 28 page thread because it's where I explain in simple terms exactly which photos we need, which is why I take people there.

Obviously you (any reader) can click to page one to understand more, if you haven't been reading any threads about the DLUHC work and have no idea what it's about. The thread is self- explanatory and if you go to the end, you can see what people are posting pics of, from all over the UK.

ALL AND ANY POSTERS CAN HELP.

More photos of no/low deterrent car parks that are not overrun by cars, please.

I don't recall stating stating that I was berated or by whom. I said I was trying to avoid beratement and also mentioned 'getting it wrong again'.  My understanding of the English language is good enough to know that if I was to imply that I had been berated on this group I would not have been referring to the lovey words mentioned. Those words are also not the only words that have been said to me in the 5 pages of this thread. So mentioning them would not then automatically devalue my claim.
I am confused, if you felt that this is what I was saying, why I would not be met with reassurance instead of defensive and absolving statements.
If you are interested in how I feel as apposed to how you view the situation, having read through many posts, there is an air of condescension.
Also, your addition does not include meaning it includes an example to demonstrate how one would the word in that context.

One of the meanings of berate is to 'give someone a piece of ones mind' If I'm not mistaken, that is what you are doing now. I have no intention of referencing other posts that resemble.

I came to this amazing group for the wealth of knowledge regarding CEL, PPA's and MCOL. I am nothing but grateful to the people who have shared the priceless information on this group. In this regard I am very out of my depth. I am quite vulnerable to the system and I am trying to learn.

I apologise. I surmised from what I read that the 'Call for Evidence' could be referred to as an appeal as it is appeared to be 'a serious, urgent, or heartfelt request'

Reading through it has definitely tongue tied my mind but it is fantastic to be exposed to such information. I would not have known any of this without this group. Very grateful. As previously stated, I have spread the word and directed people to the forum. Lets do this!

My partner has recieved a letter with a form for small claims court.
If I could get some guidance please?

It is dated 27 September but I only got it today (02/10/2023)

I have until 16th October to respond.

I also nite that on 9 August I posted that Id had a letter from the court to acknowledge and state that CEL have 40 days to respond.

That period of time seems to have elapsed. Or the courts have taken a really long time to get back to me?

Please follow the 12-point checklist from the very first post in the template defence thread that you are supposed to now be adhering to. All the guidance you need at this stage is in that checklist.

This is normal. You should be expecting these letters as it progresses.

This is why the Template Defence thread has the first 12 steps set out.

And it's why the 2nd post of the NEWBIES thread has a linked post telling you about Court Procedures in the KNOW WHAT HAPPENS WHEN' section.

Everything is covered on this forum already.

Speaking of that, surely you've been reading threads and sen the CEL v Chan judgment by HHJ Murch?

Read the forum if this is news to you.

    Include it with your N180.

You could (should) get this case struck out

Yes expecting this, I did clarify the items needing help with.

I have been reading, reading and more reading.

I went with this on my N180

I am not content for the case to be heard 'on the papers' because that seems to disproportionately give an advantage to a legally represented party. I feel strongly after all these months of intimidating demands from this aggressive parking firm and their agents, that I need a voice at an attended hearing. I wish to question the Claimant about their evidence at a hearing in person and to expose omissions and any misleading or incorrect evidence or assertions.

Found the CEL v Chan info, kindly linked in for other posters requesting it. I will send that in with my N180 form. Thanks the help.
