Well done @skoobimum. Nice win. I'm sure you'll have a great upcoming Easter weekend. 🥂Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Great stuff!skoobimum said:Yes but he barely got 3 sentences out! He was asked if he was familiar with the Chan case & to respond to that & he said the claim was issued before that decision & then the judge asked if he could have amended the POC & re-issued which he said they could but I obviously understood enough of what the claim was for to produce a 33 page witness statement & then she struck it out! 👍🏻
Which court? I was wondering if it's in the Luton area circuit where Chan is best known.
Had you already got your N244 set aside fee back? Did this Judge award any costs?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It was at St Helen’s so she’s on The North West circuit, District Judge Donaghue. I didn’t pay a set aside fee, DCB legal paid for that as it was their error in issuing the CCJ & the complaint was upheld. No costs were awarded & I was too stunned by the speed & turn of events to even think to mention any before we were dismissed. I’m just glad it’s over!2

Good. I wasn't sure if you were out of pocket. This case is a perfect example of:skoobimum said:It was at St Helen’s so she’s on The North West circuit, District Judge Donaghue. a) what can be achieved after discovering a parking CCJ, and
b) how rubbish DCB claims must be, that even in the 0.01% of cases where they think they have enough not to discontinue (as per their usual MO) they still lose in five minutes flat!

Not sure if this will help anyone but thought I’d post the court’s decision & reason to bolster anyone else’s claim 🙏🏼

I'm guessing that "as to the conduct Compland of" should read "Complained".0
