    I will attend the hearing, claimant mentioned that they are not attending the hearing and asked court to decide in the absence, do you think they are not attending or just bluffing  ;)

    It just means the C company won't attend. They almost always send a legal rep as seen in other Gladstones threads every time. You should read some, then you'll know how hearings go.

    I just replied to someone who won in court v Gladstones today... go read it.

    Hello Everyone

    I would like to thank you everyone here who have supported and guided through out. 

    Quite a lengthy journey with this case, heard back in March but DJ ordered to make an application to strike out the claim. 

    At last weeks hearing DJ considered the other judgments ( DJ Murch) and strike out the application on the basis of lack of POC.

    Will upload the judgement once received. :)
    Ooh well done.

    That sounds unusual, though...do I understand this correctly?

    You had a March hearing and the Judge actually insisted (during the hearing) that you had to go away and pay for a formal N244 application to strike out the claim?  Why couldn't he just deal with the matter of the court's own volition and using their case management powers there and then?!

    Did you get your application fee and 2 x hearing attendance costs awarded this time?

    Same Judge both times?

    Please can you show us the initial judgment or order that the first Judge sent out after that first hearing?

    That will have the rationale.  I doubt the most recent one (when the written judgment arrives) will say much more than 'case dismissed' and a costs order.

    He could have done but not sure why he insisted to fill the strike out. I will upload both.

    Same Judge both times? No different judge, initial face to face and 2nd -remote

    @Coupon-mad, I think the part you are referring to is a question that you asked and I cannot see the answer in the positive!
