CST LAW Smart Parking LBC

Hi Guys, 
I find this forum is extremely helpful to fight unfair charges so thanks to all of you who have shared valuable information.
Got this LBC yesterday, I haven't made any contact with CST or Smart Parking before receiving this. The letter alleges I owe money in relation to some car park about a year ago. Went through the Newbie thread, sent an SAR to PPC and sent a message with with the 30 day debt advice thing to CST Law.  Buy the way I am the registered keeper and haven't told them who the driver is. I moved last year so may have missed some letters from them. They are asking for 120 pounds but no details about that it is for although they named a car park. Waiting for the SAR. Just wanted to check if there is anything else I should be aware of? Isn't 120 above the cap on Parking charges anyway? I would really appreciate your thoughts on this please.

    Same as seen dozens of times!  It's nothing. Ignore all £170 threatograms.

    The SAR should elicit details of the PCN and location. Once you have that information you can start thinking about what happened and what defence points will be most useful should you receive a County Court claim form and need to draft a defence. 

    In the meantime I would recommend you write to Smart Parking and CST Law advising them of the correct address for service and that they should erase your former address. A sneaky tactic used by some PPCs is to serve claims to a former address and win by default in court resulting in a CCJ. That would be a mess to unpick. 

    There is no cap on parking charges as such at the moment but there will be when the new Code of Practice comes into force hopefully soon. The standard cost for most PCNs these days following a failed appeal is £100 but they often add a further scam £70 at debt collection stage. They will then try to bully motorists threatening to add on court costs. No-one on this forum would advise paying anything unless there is a genuine reason or a judge said so.

    I am redacting stuff in case the CST law guys are reading this thread but then I guess it doesn't matter much. I am doing this just in case. The site is owned by Parks Trust and the location is a public Park.  I am usually careful about parking and always pay attention to the signs  but  if I have broken any rules it must have been an honest mistake. Even if that was the case, I find this charge of 120 pounds seriously unfair. I have also seen PPCs doing very dishonest things. A few years ago a man came just as I was about to drive off from a car park and took pictures and slapped a ticket on the dash while we were sitting in the car. The funny thing is I didn't realise I was still within the 'grace period' as it was only a minute or two after the ticket expired. However. When I logged into their website to pay I as shocked to see the pictures have been edited with fake timestamps showing the wrong time. Funny thing is they did such a lousy job that it was obvious that it was fake. In one picture I was strapped up in the drivers seat and in the next one I was standing next to the car and those two pics were only one second apart according to their timestamps. Only super man can open a car do, jump in, shut it and put the seat belt, all in less than one second! 😂. I was waiting for them to take me to court but they never did. This is why I am very suspicious about what these companies are capable of doing.    
    By the way I have seen advice that I write to the owner of the land (In this case Park Trust) but not sure it is useful at this stage?

    CST are Debt Recovery Plus. Same bottom-feeders.  One and the same and nothing will happen.

    It is never too late for landowner complaint.

    Why the SRA think this wild bumch should be members is beyond belief ??

    Debt Recovery Plus are only money scammers and circus clowns who have nothing to do with this.

    Sent the v5c to smart parking ltd and asked both CST and smart parking to use only my new address and remove my old one. Going to post the letter to the land owner tomorrow. Thanks so much for all the help guys 🙂. Let's see what they come up with when they respond to the SAR
