After Being Served A Section 21

Alright guys

we have been served a section 21 which we need to move out by the end of July.. Everything is correct.. The only issue that we are having is trying to get another property to rent..  It's a nightmare and really stressing us out.  We are thinking that the Landlord want's new tenants to get a higher rent than they did from us.. Please not we have going trough a letting agency. My query is if we have got the landlords details can we or should we contact the landlord and suggest that we can pay a little bit more rent than we were doing so before.. Or just leave it?? 

It's a nightmare at the moment trying to find another property to rent and are running out of time before we are homeless

    Did the landlord request a rent increase that you declined before issuing the S21?

    If they didn't, it wouldn't seem sensible to evict rent paying tenants to get some new ones in before even asking the current ones to pay more rent. Have you seen the property advertised to rent or are you just speculating?

    You don't HAVE to leave at the end of the S21. Hence the previous post suggesting that's not what it actually says. They're just requesting you leave, and if you haven't got anywhere to go then you stay put, keep paying rent and keep looking for something else. You only HAVE to leave after it's been to court and the LL has appointed bailiffs.

A S21 notice can only say that they can go to court to evict from end of July. You can still legally stay there until the possession date from the court. You'd just have to pay rent as normal plus the court fee (~£3-400)
    The only issue that we are having is trying to get another property to rent..  It's a nightmare and really stressing us out.  - ultimately you will probably have to move, so I'd keep searching hard, maybe even relax the area / size you're looking for despite the advice about having a bit more time.

Or just leave it?? - no harm in asking, but if that was they case why wouldn't they have asked for more rent? By evicting, they have the costs of advertising, rental void, referencing, etc. Sure the agent may have hoodwinked the LL to get more fees, but equally maybe they're just getting ready to sell / move in. So again, no harm but I wouldn't pin hopes on this.

    Comments in line. Understanding what the S21 really means IS relevant to the pressure you feel to move out. 
  • Have you checked if the Section 21 (which as above is not a date you HAVE to leave by) is valid?

    Deposit (if paid) protected? Gas safety certificate etc

    also have in mind your next rental may (will?) require references from this landlord

    Are you a good regular payer, if so contact the LL and they may have been caught out by the interest hike needing to raise the rent higher than normal or are thinking of selling up.

    We have a 2 bed ground floor flat with garden coming up in 2 months and already we have 60+ applicants so I am not surprised you are finding it difficult.

    We are seeing people offer over the asking rent to get to the top of the list. 

    I don't know what the solution is letting agents have few available properties they mainly take details and put everyone forward for each property. Word of mouth, walking around look for property to rent signs, openrent and all the normal social medias.

    CSI was not wasting your, or other peoples' time.  The point being made is that S1 Notices  do not give a 'move-out' date. They give a date after which the LL can, if he chooses, apply to a court for possession - a process that can take further months (after the initial 2 month S21 timeframe.)


    Everything is correct.. 

    Are you sure? Have you checked all 85 questions in this checklist? Given you are seeking help due to the difficulty finding a new tenancy it's worth making sure the S21 is valid. Many are not
