  • Acknowledgement of Defence received from HMCTS. Await expected further demand from DCB Legal. 
  • Have submitted my defence on 26.6.23 to the CCBC on line and received an acknowledgement. Have this week received DCB Legal's response (that their client will proceed to court) with a copy of their N180 attached. Can I wait to receive the same N180 questionnaire to complete from CCBC or should I download one and sent it in now? I have not been told what date this N180 has to be in by. I know a copy has to go the the claimant's solicitors. They want the hearing to be carried out by CVP/Phone - I want it to be dealt with in court face to face.

    Have you abandoned that checklist you were following when you filed a Defence?

  • I was expecting it and haven't abandoned the checklist; just a bit edgy in case I missed a date or something.

  • The N180 has just arrived by post from the Court at last. Have noted minor alterations in N180 from earlier version referred to in Newbie. Current D1 'Suitability for determination without a hearing' is obviously 'No'. The claimant's solicitor (DCB Legal) also files 'No' with the following reason: 'There are factual disputes that will need to be heard by the judge directly and the Claimant will need the opportunity to cross examine the defendant and test any evidence put forward by the Defendant. There are also complex issues of fact and law that will be best argued orally.' Any suggestions about how to respond in the text box under 'if No, please state why not' to this - other than applying common sense?

  • Have submitted N180 during working hours to CCBCAQ@Justice.gov.uk with a copy to the claimant. I've requested an 'in person' rather than telephone or video hearing and have given reasons.
