  • Total Car Parks Lld claimed £100 offset to £60 for payment within a month. This was inflated to £160 by Debt Collection Bailiffs Ltd (DCBL) which the Claimant DCB Legal is pursuing. Is it known whether this particular claimant routinely claims £160 per alleged PCN and also whether this claimant uses third party pre-written templates as standard?

    Don't try and overthink this. Just use the defence template as advised. You are answering the claim made in the PoC, which in the case of DCB Legal is woefully inadequate.

    To answer your other question, yes these gits always try to get £160 at false 'debt resolution farce' stage and they all use template letters.

  • I've completed my Defence. Just wondering, when sent in,  whether this should be accompanied with supporting documents/images or are these held back to be presented later with the witness statement?

    Nothing gets filed with a Defence.
    As you say, evidence gets filed and served at Witness Statement time - some months away.

  • I'm having issues with scanning and e-signatures. Is there any objection to me sending my completed Defence by registered post to the Court Manager in Northampton as an alternative to email? My deadline is 5.7.23 so I want to get on with it I understand they then send it to the Claimant.

    That would be terrible, especially if posting on a Friday!  No-one will sign for it and it WILL disappear or be misfiled.

    Northampton CCBC is ENORMOUS and shares the Head Office with other services such as the Penalty Charge TEC Centre.

    Have you ever worked at a huge multi-corporate Head Office?  I have.

    Think 'black hole'.  They are designed not to handle reams of paperwork, which is why the MCOL system is online.
