    Not exactly.  The courts don't lie but a mediator may have misled him.

    You can of course get a CCJ on your credit record in the end, if a Judge rules against you AND YOU THEN REFUSE TO PAY WITHIN A MONTH so I expect he misunderstood.

    He cannot get an auto CCJ and absolutely should never have done Mediation.

    We need to see that defence please.  The one he put in writing in response to the Claim.

    We just have the simple defence in mediation (by telephone) of “he took a wrong turn and drove out again not stopping” 

    Exact defence words please, so we know what he can put in his Witness Statement.  I'm sure he can't have just written less than ten words in the box?

    I am not talking about the phone Mediation.

    I'm asking for the words he put in the defence box (either online using MCOL, or by filling out a reply form and posting it) when he got that claim form.

    We have not written any witness statement or written in any box as yet. We haven’t gone to or decided to proceed to court yet. 
    We will certainly prepare something thoroughly in due course. 
    We have had no option to appeal whatsoever due to PCN not being received. 

    You are mistaken.  He HAS defended the claim.

    Please ask the CCBC next week to send you his defence if you've forgotten that step and didn't keep a copy.

    Due to my nephew’s mental health, he really can’t go to
    court! I was able to deal with mediation on his behalf

    As it was by telephone, I suppose no one noticed but the OP needs to rapidly get to grips with their understanding of the process before this goes south.

    I realise you know your way around this forum like the back of your hand but it’s not easy to find this “Newbies” post. 
    We know, we sympathise that forums are new to most posters, which is why my signature under every reply I post, tells new posters how to hop there in 2 clicks.

    P.S. the Mediator lied. There's no auto CCJ.

    We felt we had no choice but to agree to mediation to avoid the CCJ!
    That was incorrect.  There is no risk as long as he does it right from now on.
    Last question for now until I’m back to add the defence comments sent to the CCBC in December!
    Mediator has given us until 16.00 on 12th to give her our choice of paying up or court. How should we handle that?
    Don’t want to make another schoolgirl error!

    Here is my nephew’s defence sent via email in January. I realise it’s not brilliant just a simple, honest account. We now know what not to do!
    I am disputing this claim on the grounds that I did not park or stop at any time. I was in the traffic of the lane for 2 minutes due to taking a wrong turn. I have paid for parking on this date which can be confirmed by Gatwick Airport Parking. I have dash camera footage to back this and the airport CCTV will do the same. 

    Furthermore, I moved properties at the start of July so did not receive this letter till picking up old mail in January meaning I did not have a chance to dispute this sooner. This was notified to the DVLA in July.

    I'd also like to see the footage to understand why it took 2 minutes from camera to camera, because when I complained to the BPA last year about this specific NCP 'cash cow' site at Gatwick, the BPA told me the route would take under a minute.

    I'd welcome evidence to prove them wrong.

    He wasn’t driving normally as he realised he’d gone wrong and panicked a bit.

    I may have missed someone else flagging it up, but the VRM, bwlegal claim number and MCoL password are all visible on those images you have posted. It is advisable to redact all such information, so you may want to edit that post!
