  • Do the AOS right now...you are late and you are at imminent risk of a CCJ, if you haven't done the AOS.

Don't worry, as you can see below I have done it in a timely manner.

I have submitted a SAR to UKPC (6/6/23) and intend to fully prepare my defence using the template as a basis. I have also completed the AOS (on 6/6/23 - delayed as I was also away) and so now leaves me approximately a further 2 further weeks to prepare my defence.

Thank you for putting in a FOI, will be interesting to see what you discover

Also - secondly - reply to that email and tell the person that you are receiving dedicated advice from an experienced team of people who deal with rogue parking court claims every day.  The Trust MUST NOT tell people "not to engage with a court claim" which is appalling and worrying - that causes a CCJ!  You must tell them never to say that or they are causing CCJs.  Claims MUST be defended and you are happy to be put in touch with other victims if other staff need signposting to free help.

    I will do.

Here is an update with the latest response from the trust having heard back from UKPC having spoken to them on my behalf...

    Good Morning,
Some good news to start the week.
I received the following from UKPC –
     External] K1KF05X8
This charge will also become stayed provided no action is taken by the appellant

    Kind Regards

    Car Parking

I am unsure what guarantee this has that the charge will be dropped at this stage and therefore I assume I should still produce the defence as planned?

You can't not defend.  You must defend a claim.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

About as useful as a poke in the arm with a sharp stick. Unless you are happy to have the threat of them reviving the stayed claim at any time in the future, you should tell them to go swivel on the sharp stick that you poked yourself in the arm with.

Just carry on defending as advised using the defence template for UKPC/DCB Legal claims and they will discontinue anyway, which is what you want. No stay of execution.

Here is. link to an example of the defence template you need to use:

    Hi,

I would appreciate you help and guidance. I have read the NEWBIES thread and have also seen some thread about DCB legal and am therefore posting my case on here.

I have received a county court claim form on 19th May 2023 from DCB Legal regarding a historic PCN by UKPC from August 2018 at Stoke Mandeville and Wycombe Hospital staff car park. They are asking for £120 (total of PCN and damages) plus 8% annual interest + £35 court fee + £50 legal fee to total £255. The POC states the date of the PCN and provides a PCN number. Specifically it states the PCN was issued on private land owned or managed by UKPC. As the vehicle was parked in breach of UKPC’s displayed signs (the contract). It states the driver agreed to pay within 28 days but did not. It states I am liable as the driver or keeper. It states that despite requests the PCN is outstanding and the contract entitles UKPC to damages. Claiming as above.

    ...

At the time I was a doctor employed by this NHS hospital trust having just started there. I was paying monthly from my salary in order to park in the staff car park.

    Stoke Mandeville and Wycombe Hospital

    ...

Prior to posting this I have already received the SAR from UKPC within 24 hours. It shows on the notice to keeper that the initial penalty change was £60.

I have also contacted the hospital trust who are going to directly contact UKPC. It appears the trust had come to an agreement to write off any parking notices issued against staff by UKPC.

Nevertheless I intend to produce a defence as I am unsure what will happen next!

@hospdoc what has happened since? Did they formally discontinue or did you defend?

Would you be kind enough to grab a photo of the £60 PCN charge on the sign at either Stoke Mandeville and Wycombe Hospital or wherever you are now, please?

And same request to @cdotbdot about Milton Keynes Hospital if the non-discounted PCN sum was under £70.

We are urgently (September only) collecting photos of signs asking for £70 or less.  Common at Hospitals (usually £50 or £60).

Please identify the Hospital, and post your image here:

That's an evidence thread that I will use for the Government this month, to help regulate rogue parking firms as part of the final steps in changing the law.

What a load of utter crap from DCBL ... IN 2018 UKPC signs did not mention DAMAGES ..... it is a cloud dreaming invention by DCBL and worst of all DCBL abuse one of their staff called Yasmin Mia  TO SIGN A STATEMENT OF TRUTH which is a blantant lie

Damages on NHS property ???  UKPC were only the vermin employed to manage the car park

If DCBL have a problem with this post, we know they read threads on this forum, they can PM me and we can follow this through with the SRA and MoJ ....

Do not accept the rubbish from DCBL
