DCB legal going to court for parking

    But you have told us that you used the MCOL defence option which restricts you to 1,080 characters and that you adjusted accordingly. If you are saying that you tried to paste all that into the MCOL box, all that they received will be the following:
    1. The parking charges referred to in this claim did not arise from any agreement of terms. The charge and the claim was an unexpected shock. The Defendant denies that the Claimant is entitled to relief in the sum claimed, or at all.  It is denied that any conduct by the driver was a breach of any prominent term and it is denied that this Claimant (understood to have a bare licence as managers) has standing to sue or form contracts in their own name. Liability is denied, whether or not the Claimant is claiming 'keeper liability', which is unclear from the Particulars.

    The facts as known to the Defendant:

    2. The Defendant was the registered keeper of the vehicle in question. The Claim relates to an alleged debt arising from the driver's alleged breach of contract, which is denied. It is further denied that there was any agreement to pay the Claimant a £100 'parking charge notice' (PCN).

    3. The defendant denies being made aware of any such contract and therefore denies that any contract agreement was entered between the two parties.

    Who is the Claimant, please?

    And can't you see from your MCOL history exactly what was accepted as your defence.

    @Grizebeck will know: is it 1080 LINES not characters?  And does MCOL history show what went in as a defence?

    @Grizebeck will know: is it 1080 LINES not characters?  And does MCOL history show what went in as a defence?
    I enquired directly with CCBC IT and they confirmed to me in writing that the MCOL defence box has the same limitation as the PoC box, 1,080 characters.

    I doubt that is right.  I've seen longer defences years ago that fitted.

    Sorry parking control limited. I'm finding it a very confusing, the only reason I was in a McDonald's more than 90 minutes was becuase my son has aspergers and if he doesn't want to leave, we don't leave til he's ready. I honestly had no idea of the parking restrictions and I noticed no signs. There is not a clear sign at the entrance

    This is the eventual response I received from the CCBC after much email ping pong from staff who had no idea until it got batted up to their IT dept:

    Good morning.

     The word limits for particulars of claim and defence are the same.

     Please note: you cannot attach documents or pictures as evidence.

     You need to put the main defence points but can refer to other separate documents/exhibits.

     Any extra information can then be filed later, if the case proceeds to a Hearing date.

    But she doesn't go on to tell you/us/me/him/her what the limit is!  I think she will find that if you try to "file later" as in adjust your defence it costs £108 (that may be incorrect but it is definitely over £100)
