Hello Experts,
I have received a county court claim form dated 30th May 2023 from DCB Legal for 2 PCNs from Nov-Dec 2018. It is difficult to remember exact circumstances but I think i had paid for one or both of them and overstayed as my wife was in west Middlesex hospital maternity ward. They are claiming around £550 for 2 pcns. Please could you someone advise how should I approach this. Can the NHS trust etc be contacted for them to be cancelled?
Many thanks

dk007 said:I have received a county court claim form dated 30th May 2023 from DCB Legal...With a Claim Issue Date of 30th May, you have until Monday 19th June to file an Acknowledgment of Service but there is nothing to be gained by delaying it.To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 3rd July 2023 to file your Defence. That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.1 -
A complaint to the NHS Trust should have been made years ago. The PCNs would have been cancelled easily 4 or 5 years ago.

Which parking firm? UKPC?You must defend this fully, but be aware that should you continue through the required phases, DCB Legal are likely to discontinue, but you're some months away from that at the moment. Be resilient. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

If the claim is from DCB Legal, just use the template defence as shown here:
https://www.dropbox.com/s/5r7vbqttho3q948/2023 defence.pdf?dl=0
You are responding to the woefully inadequate PoC signed by Yasmin Mia so nothing elaborate is required for your paragraphs #2 and #3. Robustly defending claims made by the bottom-dwelling DCB Legal are mot likely to end up being discontinued as pointed out in the thread highlighted by @Umkomaas above.3 -
Hi, Thanks for all the responses. The parking firm is UKPC. I have prepared the defence as per instructions below and about to submit as today is last day, please could someone advise, if i can sign the witness statement electronically on pdf ? Thanks

Also, in the template defence, do i include para #4 or exclude, not sure if it is PoFA compliant or not?0

You started this thread on 5th June.
Four people replied within a day of you starting this thread.
You were given good guidance at that time on how to create and file a Defence.
As I said four weeks ago...Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 3rd July 2023 to file your Defence.Did you file an Acknowledgment of Service within the timeframe suggested?
That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
If so, you now have just three hours to file a Defence.
You also mention Witness Statement. That's some months away.4 -
Hi, yes, i did file a AoS within the timeframe. I just need answers to queries i raised above,
do i include para #4 or exclude, not sure if it is PoFA compliant or not? I can not recall if a Notice to Keeper was issued as it has been a long time.
also do i need to email the defence to email id: CCBCAQ@justice.gov.uk
and if i can sign the defence electronically?0 -
do i need to email the defence to email id: CCBCAQ@justice.gov.ukYes, signed electronically, as a pdf file attached to the email to that address.
and if i can sign the defence electronically? But there's more than that to do in the coming weeks and months, as outlined in 12 steps in post #1 of the Template Defence Announcement. With an ongoing case it is not advisable to leave contacts with the forum many weeks apart, asking for analysis and advice on the day before deadline. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You are coming back in 3 or 4 weeks to join us all for the DLUHC's final public consultation to get the new law over the line, at last?
