UKPC PCN Crown Point Leeds - "Driver left site designated for customer parking only"

Hi all, I am new to this forum and this is my first post so please let me know if I have done or done something as per the rules.

I have joined this group to help our neighbours who have been facing few issues with the PCCs in past few years, specially since Covid started. Many of our neighboughrs are NHS employees and don't have time and energy to deal with these things so end up paying initial charges or increased fees due to the fear of court or the threating letters they get.

This perticular one is recent. The Registered Keeper has received the PCN asking for payment of £100.

The evidence provided on the letter and on their website are barely pictures of parked car and nothing else. After reading the newbie section, I believe the below are the steps to take by the Registered Keeper (I have few questions if you could help me with please):

1. Email to the shop owners (CEOs or any possible of ASDA and Iceland) [Any template they can use please?]
2. Email to local MP [Any template they can use please?]
3. Appeal to UKPC (26th day) [question - 26th day from the day of parking charge date or the letter date?]
4. If appeal gets rejected then wait for POPLA code
5. POPLA stage and then further steps

The Driver and their family browsed the shopping centre and did spend cash and with card in the shops. The only receipt they took was from The Food Warehouse (Iceland).

The incident happened 18 days ago. Letter printed 13 days ago and received by the keeper 10 days ago. Due to foot injury and busy schedule they did not get chance to contact anyone yet and talked to me few days ago. Since then I am trying to find ways to help them.

I am sharing the PCN pictures and tried to redact the information as much as possible but if I have overdone then please let me know.

    This is a typical UKPC scam they invented it and try it all the time, if you never left site they won't have any evidence, if you did leave site they won't have any evidence.
    They would need to put a plan up of the site boundary and make it clear that you were not allowed to go past that line, but in any case their attendant should mitigate the land owner's losses by stopping people from doing that rather than giving out a retrospective invoice.
    The onus is on UKPC to prove that the driver/and or occupants of the vehicle left the site, not the other way round.
    My own theory is that they probably stick charges on a number of random vehicles in the off chance some of them will have left site and just pay up.
    No there won't be any evidence, and the only person that they could bring to court as a witness would be their operative who will either have left by then won't remember you from Adam or would be far more lucrative to them out on the road scamming more victims.
    Only one case that we can remember of this type that went to court landed that PPC in deep do do with the judge who threatened them with a few days in a large free Victorian hotel sharing a room, no one has tried that scam since.

  • Thank you fisherjim and Grizebeck. This surely gives some confidence. The RK is feeling bit relaxed when I shared it (just now) with them.

    Could someone please direct us to the templates we can use for emailing supermarkets and local MP, or an example or wording to use, as RK has never done this and I am doing it first time as well?

    Also, is RK right to appeal on 26th day of parking charge date to UKPC?

    3. Yes, but the 26 day strategy only works with a windscreen tickets. PCN received via post, appeal at any time before the parking firm's deadline (usually 28 days)
    4. Yes, but there may be an interim stage where UKPC writes following receipt of the appeal asking for details of the driver. Ignore that, the rejection letter and POPLA code will come through around the 35 day point from the date of the initial appeal
    5. Yes - success at POPLA for a 'leaving the site' case all but guaranteed. Remember, it's for UKPC to present the evidence, and they won't have it. Go to their website, log on and check all the photos they have of the incident. Even if they have a photo of one of the passengers, they can't pin that on any person as they don't have a national database of faces. It's just a grubby scam, with enough naive motorists paying up and providing the lifeblood for this particular income line.

    Always best to write complaints anew as it sounds better and you/the complainer will know the facts and how it made you feel and why you are never using that store/shop/pub/retail outlet again!
