Troublesome Tenant , deposit scheme, etc.

    The tenant sneakily left just before the Section 21 notice was due to expire. Locks have been changed as none of their possessions are inside. Now, solicitiors need to be approached again about the rent arrears. There is also a letter from the utility company about unpaid gas & electricity bills and it seems they were not paying for months and it has now accumulated to £1500!
    Your sister should tread carefully. It was ambiguous whether or not she took a deposit. You claim she did not but she did eventually protect some money as if it were a deposit. In my opinion she should count herself lucky the tenant left before court action was required and chalk the arrears up to experience. Should she push it I don’t think the tenant would have much trouble counter-claiming she did take a deposit and protected it late. 
  • The tenant has ran away now and had been paying the rent in dribs and drabs. They still owe my sister 5 grand.
    Should she go to a small claims court or to a solicitor to recover this?

    She should go to small claims to get a CCJ but the chance of recovering the 5 grand is next to zero.
