UKPC Claim Form using DCB Legal

I have spent a long time reading through all the information. Huge thank you to lots of you, especially @Coupon-mad for the template defence.


I received a Parking Charge from UKPC five and a half years ago when parked in a visitor’s space at my friend’s. I was unaware that you needed a permit, even in visitors, as the signage was sparse and small, with tiny writing. There were also no signs as you entered the road. At the time, I panicked and contacted them to appeal. I filled out the appeal, received both on screen confirmation and then a confirmation e-mail stating that my charge was on hold and that they would aim to respond in 35 days. I received no further communication as to the result of the appeal. Quite some time later (I think it was about a year and half but I honestly couldn’t be sure) I started to get the debt collectors letters, which I ignored (incorrectly, I now know!). I have now received a Claim Form, which is how I find myself here.

 

I attempted to submit the AOS online but I cannot log on. When I attempt to log on to MCOL I get redirected to Govt Gateway and then when I log on there and enter the claim no, I get booted back to logging in to MCOL. Not a problem as I contacted CCBC and submitted the AOS directly through e-mail and will be submitting the defence the same way. Issue Date of Claim is 11th April and I submitted the AOS on 26th April and got an auto-generated receipt of e-mail the same day. I’m aware that I have until 14th April to submit my defence, which I have prepared.

 

I am not changing anything from @Coupon-mad’s template apart from paragraphs 2 & 3, which I have put below. Paragraph 1 is unchanged. I then added in @Johny86’s paragraphs 4-11 and then @Coupon-mad’s 4-27 are afterwards unchanged (apart from being numbered appropriately) finishing the defence with 35 paragraphs. Would anyone be able to suggest any improvements, please? Also, for the signature, can you just type your name or should I scan my signature and insert it? (Then save as pdf and attach to the e-mail.)

 

2. It is admitted that the Defendant was the registered keeper and driver of the vehicle.

3. The defendant was visiting someone and parked in a marked visitors bay. There were no signs at the entrance to the road to state that there were parking restrictions and once in the car park the signs were sparse and posted high up with extremely tiny writing making them exceptionally difficult to identify and read. Due to the lack of clear, appropriate signage, the defendant was unaware of their presence and was therefore unaware that a permit was needed even when parked in a visitor’s bay. An appeal was submitted but never responded to.

 

As I am unable to access MCOL will I be e-mailed directly? Should I state that I cannot access MCOL? Thank you so much for any help given.

    You mean 14th  15th May (Edited as per @KeithP's post) ... :smile:

    Well done so far, you have clearly done your research.

    MCOL is now read only and so it's not essential. Everything will be sent to you via email or by post.

    Have you tried contacting MCOL for advice?

    Don't stress. From your research you must have seen that this scamming duo tend to discontinue a robustly defended claim.....

    Hello and welcome.

    Good to see you have overcome your MCOL issue. 
    MCOL will no longer be important to you.

    With a Claim Issue Date of 11th April, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 15th May 2023 to file your Defence.

    That's over a week away. Plenty of time to produce a Defence and it is good to see that you are not leaving it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Hi @KeithP, I can't access MCOL anyway so was just worried that it was the only method of communication. My defence is prepared - I studied the post you referenced extensively, as I did with many others - and I posted paragraph 3 above which I was hoping to get some feedback on. Do you think it's ok? Also, do you know if you can just type your name to sign the defence or am I better inserting a scan of my signature. Thank you for your help.

    All good but remove my para 4 AND Johny's para 4 from your defence.  Neither are right in your case.

    @Boat_to_Bolivia this forum has given me hope that it will, in fact, be discontinued as long as I follow the guidelines set out here. It is DBC Legal. I did contact MCOL who directed me to CCBC as they absolved themselves from any responsibility for the website not working! The lady was perfectly pleasant but ultimately, after being on hold for over 40 mins she couldn't help. At least after being on hold for almost an hour for CCBC the lady gave me the e-mail address and I could submit my AOS.

    @Coupon-mad thank you, I've removed both paragraph 4s and renumbered the remaining ones to make a total of 33 paragraphs. I'm so grateful for your help and the work you've done on these forums.

    @Coupon-mad how do you sign the defence? I've typed it in Word but will convert to pdf before submitting. Do I just type my name where it says Defendant's signature or should I scan in my handwritten signature and insert it before saving? Thank you.
