Van broken 1 month over 3 month warranty.

Hi everyone any help appreciated.

I purchased a van from a dealership 4 months ago today that came with a 3 month warranty and as with these things last week the engine warning light came on.
I took it to my local garage and they did a regen as the code was something to do with the anti pollution system, this did not fix the problem so they then did a chemical dfp cleaner.
This was ok for about 15 miles then warning came back, then the code was showing oil needed changing so oil and filters were changed, this cured the problem for 15 miles again then warning light came back on.
Took it to main Renault dealer yesterday for diagnostic check, they cleared all the codes and reset the parameters to tell it it had these things done and told me to take it on a long drive which I did however the warning light returned.
Called Renault this morning they could only suggest I take it in for a full day to find out the problem, however after speaking to them yesterday if the dpf did need to be replaced I would be looking at £3500 + for them to do it.
I called the dealer where I got the van from this morning and they said that because it was out of warranty they could look at it however I have to cover the costs so basically have just washed there hands of it.

I am currently in the situation where I am spending money to trying to fix it, as I don't mind if its general wear and tear, however if its something major already as I have done less than 3000 miles since I have had it, do I have any consumer rights at all?
Obviously I don't want to keep spending money on it if its not getting fixed and at the moment looks like I will have to get it done at a Renault dealer so this is going to cost a lot.

I purchased the van with a bank loan for £14,500.
Just wondering if I have any rights to return it to the dealer where I got it to repair it as I have only had it 4 months and currently cannot use it?

    They haven't washed their hands of it, they've agreed to look at it.  I suggest you let them, because you can't exercise any consumer rights without giving them a chance to inspect it.  It's perfectly reasonable for them to charge to do so, because you may find they're not liable for whatever is diagnosed.  
  • I called them this morning and spoke to the service department, He said that obviously Renault have better diagnostic equipment than they have as they are not a main Renault dealer and only have a generic one for that make however if they do look at it I will be liable for all parts and labor.
    I don't mind them having a look and charging me for it, as long as they can fix it, however if it is a major issue that will cost loads to fix I would probably take it elsewhere if I have to pay for it anyway and have no rights regarding the van.

    You do have rights, but unless you're prepared to let them inspect it, it's going to be trickier to exercise them.  You'd have to get another dealer to inspect and diagnose the problem (which you'd presumably have to pay for) and then if the problem was deemed to be present at time of purchase, take it back to the seller to give them first chance to fix it.

    What type and model is the van? I drive a VW Crafter and I haven't had any problems. DPF can need replacing, but your oil light also came on. Perhaps this is an electric issue and not a DPF issue?
  • Renault traffic swb 2019.
    Oil light didn’t come on but code was in system so that was changed.
    Renault diagnostic yesterday reset the parameters to tell it this had been done and said take it on a run as faults were cleared.
    All ok then fault came up 15 mins on the run.
    Just as I got to home fault turned to engine failure hazard so it’s just sitting on driveway now.
    The diagnostic from Renault was £135.00 and I still don’t know what’s wrong with it.

    Engine failure hazard ». Indicates an injection fault, the vehicle's engine has overheated or there is a serious engine fault.
    So this is not just about the DPF.
    How many miles has it done, previous service history?
  • Done 100k
    Full service by dealer when I got it so 3000 miles ago and full service history from Renault.
    Engine failure hazard came up once before but code displayed was something to do with anti pollution system so had a dpf clean and since then engine failure hazard didn’t return but check anti pollution system keeps coming back.

  • Just for my benefit (and possibly @Carlisle1967's ) is the view that s19(14) of the Consumer Rights Act 2015 (legislation.gov.uk) doesn't necessarily apply to motor vehicles because of either of the two exceptions in s19(15)?
