Hey Guys, how long should it take to receive the DQ. Been a while now and I start getting a bit anxious that the mail might have been lost etc

The CCBC sent you a letter saying the Claimant has twenty eight days to consider your Defence.

What you don't know is when the CCBC sent a copy of your Defence to the Claimant. It follows from that that it is not known when the Claimant has to respond to the CCBC.

Further, we don't know what delays there are in the CCBC that means they don't send you a Directions Questionnaire as promptly as you might like.

And this recent thread indicates that longer delays are likely... CCBC are currently 26 days behind with DQs

Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back at the CCBC, remembering to send a copy to the Claimant of course?
  • Sure. Thanks @KeithP

    Regards

    Hello everyone,

On August 23rd, I departed from the UK for a holidays and returned today, September 2nd and found this letter, looks like delivered some day after my leave. Based on the content, I am already one day overdue in responding:/

What would you recommend as the next course of action? Should I reply with evidence of my absence, or perhaps respond regardless?

    Regards,

    SC

Just download the N180 from https://www.gov.uk/government/publications/form-n180-directions-questionnaire-small-claims-track and fill it in now. When completed, you should email it as a pdf attachment to ccbcaq@justice.gov.uk and CC in the PPC or their solicitors, if they're using one. Also CC in yourself as definitive proof of posting. You should receive an immediate auto-response from the CCBC. If you don't try again and if still no auto-response, use a different email agent.

The danger of being late in responding it that it leaves the path open to the claimant to go for a CCJ by default. However, if you are late with your N180 DQ, they usually send you a reminder first.

So, just get on to it now and send it off. There is no need to explain why it is late and don't highlight it wither.

Just respond as described in items 8, 9 and 10 in that checklist in the opening post of the template Defence thread.
Best to do that today or tomorrow.
Do not even mention anything about it being a late response.
  • Sorted.

    Thank you so much everyone.

Good to see they have taken the trouble to update all their forms before deciding to change their name to Civil National Business Centre - oh, wait, they didn't, they had to hand write it on the DQ form!
  • Hi everyone. This morning, I received an email from HMV&TS regarding mediation (screenshots attached).  What would be the next move please?

    Regards,
    SC

  • The first bit tells you how to cancel... because you can't answer "yes" to all 3 questions. So, there's your "next move".
