Forgot to update V5C, PCN not received

It's Quayside Poole Car Park. I have found posts relating to it, where a lot of people had trouble paying with machines. We paid by phone however. From what I've seen people have appealed their charges because they were genuinely unfair, having paid and left in the allotted time, unlike myself. I also did not have the chance to appeal in my situation as I did not receive a PCN due to not changing the V5C address. I haven't yet found a post with a complaint mentioned, I was looking for this to try and find out who to go to.KeithP said:Where exactly did this parking event take place?

I only told BW Legal to erase my address on the advice of @Coupon-mad and only asked for erasure. BW Legal have my current address already, but I only ordered them to tell the PPC to erase my old address not give them my new one, as was advised here.1505grandad said:Just checking - have you also advised PPC of your correct address and erase old one?

But the SAR example on the NEWBIES thread includes a line about erasing an old address, and the SAR goes to the PPC. Did you include that bit?

Hmm I can't see that, am I looking in the wrong place? The newby thread says this about a SAR where I'm looking:You do NOT have to supply intrusive ID (intrusive = driving licence or Passport) so refuse that if they demand it, but you do have to show that you are the correct data subject. So attach a scan of your V5C if you still own the car, or if not, a utility bill to show your name and address.A SAR is free. Ask for (as a minimum):Apologies, but I'm a little confused now as I'm hearing different things, is it okay to give the PPC my current address and tell them to erase my old one? I was under the impression I was to go through BW to tell them to erase the old address from theirs and their clients databases, and explicitly not to get them to tell their client my new address. But if it's safe to do so, I will tell Britannia my new address and ask them to erase the old one directly, when I get a reply for the SAR.
- ALL photos taken
- all letters/emails sent and received, including any appeal correspondence earlier
- if the car park was Pay and Display, ALWAYS ask for a PDT machine record from that day, of payments made (VRNs can be partially redacted but insist on getting this; follow it up if they refuse).
- all data held, all evidence they will rely on, and a full copy of the PCN, NTK
- and a list of all PCNs outstanding against you and/or this VRN, and remind them that any claim must be for all PCNs, not several separate claims.0 -
I'm unsure how to find out who the land owner isSOME IDEAS ON DETERMINING WHO OWNS THE LAND1. Google searches2. If a retail park, check on any signage which lists the on-site outlets3. Ask retailers on the site if there is a managing agent4. Ask retailers on the site to whom do they pay rent5. Contact the local authority and ask who pays the non-domestic/business rate for the car park (some councils have a spreadsheet on their website)6. Contact the local Valuation Office and ask if they know. They often have a website which might provide the information7. Contact The Land Registry and for around £3 they should be able to provide definitive detail8. If you haven't already done so, give us the name of the car park/site/location, we may have seen other cases there.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Yes, tell Britannia to erase your old address...of course all of them need to do that...especially the Claimant (Britannia).

Not sure where you got that bit of misinformation from. The whole point of telling all parties involved in bringing a claim against you is to make sure they all have your correct, current address for service of the claim. What would the point be to tell the solicitors to "erase" your old address and update it with your current one but then tell their client to "erase" your old address but not give them your correct address? It is the PPC who is bringing this claim against you. The solicitors are only doing what they are instructed to do by their client. What I meant by that (sorry - I can see it is unclear now) was that the advice wasn't to ONLY communicate the new address to BW Legal.
The advice was (and always is) to tell Britannia too when doing the SAR, not relying on the likes of BW to tell them.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
