Thanks for that, I have implemented the changes into my defence. *Exemplar WS bundles* Can you send me a link to the bundles please? I cannot locate it? Kind regardsCoupon-mad said:Remove para 4 and 5 because they are irrelevant to your case (you've not seen the claim, and at this stage after a CCJ set aside, they won't send template letters; it will progress to a hearing).
Change this (the bits I've highlighted) into your own words instead, or remove these phrases, because it talks about a claim you've never seen and 'keeper liability' is irrelevant in your case:1. The parking charges referred to in this claim did not arise from any agreement of terms. The charge and the claim was an unexpected shock. The Defendant denies that the Claimant is entitled to relief in the sum claimed, or at all. It is denied that any conduct by the driver was a breach of any prominent term and it is denied that this Claimant (understood to have a bare licence as managers) has standing to sue or form contracts in their own name. Liability is denied, whether or not the Claimant is claiming 'keeper liability', which is unclear from the Particulars.I would also recommend you do a separate Witness Statement and evidence to support this defence (now = a full bundle and a costs assessment together with your defence, even though the Judge only asked for the latter) because after a set aside, that stage stupidly gets bypassed by most local courts, leaving the person with zero evidence filed. Unfair but true, so pre-empt that with a full bundle.
Exemplar WS bundles to copy from are in the recent threads by @aphex007 and @SJRRJS which also include a costs assessment.
Make sure your bundle is emailed and/or posted to the local court (not the CCBC in Northampton) and to the C's solicitors too.1 -

I have submitted my defence today around 30 minutes ago but have not received an auto correspondence confirmation from dcb legal and Shoreditch county Court. Should I be worried? Thanks.0

You're submitting outside of normal business hours (9-4) which has been known to cause problems from time to time. Keep an eye on it this evening, if you don't get the acknowledgment, try again tomorrow morning.Metaphysicist said:I have submitted my defence today around 30 minutes ago but have not received an auto correspondence confirmation from dcb legal and Shoreditch county Court. Like the banks, anything that takes place after the end of the working day is attributed to the next working day.
Keep your fingers crossed, and as previously mentioned, resend the email during working hours early tomorrow.2 -
