    All good (with the above tweaks) as long as the Claimant hasn't sent further and better Particulars/evidence after your successful CCJ set aside hearing, or provided they didn't already send a load of photos and evidence with a detailed witness statement before that hearing?

    If they did, then you can't say you don't know from the POC what the claim is all about.

    Remove this from 2, as it's already in para one:

    " but liability is denied."

    Hi, thanks for that! Claimant had a bunch of photos that they had with them in the hearing yes. So I take it I cannot deny liability? Remove that from the defence? Thanks for all the help everyone you guys are great!

    Some of your page numbering shows 'x of 10', others are showing 'x of 13'. Needs checking. 
    What could help is if any part of the claim (or their Witness Statement or Evidence Bundle) is showing 'Terry Szmidt (T/A)'. Just search for that in any of the paperwork you have from them.

    Not clear what you're meaning. If somewhere their document(s) is saying 'Terry Szmidt' (T/A)', in which document is it?
    Hi, sorry for the delayed reply. I had to shuffle through all the paperwork in order to find it. It’s in the letter of claim prior to county court claim. I have uploaded a screen shot. Does this help my defence in any way? Kind regards and appreciate your kind support.

    Here is the screenshot. 
    Would be better if that was showing on the actual county court claim form. Did you check that. 

    As it stands, I don't think it provides a knock out punch, but you could mention in your WS that you are confused as to which entity is pursuing you because of what the LBC states. You say that you are bringing it to the attention of the Judge who may similarly be uncertain as to who the Claimant actually is, and does it point to other discrepancies in their submitted documents. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I didn't say you couldn't deny liability and I wasn't talking about photos they had with them.

    Apologies for the mixup. Claimant sent me and the court in question their witness statement prior to the set aside hearing. I understand that means I am not able to deny from the POC what the claim is .

    Unfortunately it’s not on any of the county court documents. I will add what you have mentioned on my defence. Thank you

    OK so you can't use the extra paras seen in the defence by Johny86 about the POC.  So just use the Template Defence itself, which doesn't include those.
