Debt Collection Bailiffs / POPLA / ParkingEye

Hi all - just after a bit of advice / info if possible please
Received a parking charge notice back in July 22 (forgot to input car registration whilst at cinema) for £100. Disputed with evidence e.g cinema tickets to both ParkingEye and the POPLA - lost both appeals - unsurprisingly from what I have read elsewhere .
I have now received a notice of debt recovery (£170) from DCBL bailiffs (from that awful Can’t Pay Take It Away programme)
The letter states ‘You now have 14 days to pay or call us to discuss repayment. This case is not subject to High Court or bailiff action, however should you fail to contact us we will recommend to our client the commencement of legal action against you.’
Loathe to paying it to be honest as mine was an honest mistake whilst a patron at the cinema with my daughter- was hoping that it would all peter out tbh.

It is a letter from a powerless debt collector, DCB Limited, and can safely be ignored. The clue is that it gives 14 days not 30 to pay, and clearly states it is not the subject of court action.
It is often thought that if ParkingEye are using debt collectors then their contract with the landowner does not permit them to issue court claims.
Plan A was and still is for you to complain to the landowner and your MP.

Yep, see you if DCBLegal issue a court claim, IF you can't get PLAN A (see NEWBIES thread) to work.
You do not pay £170 to DCB Group. Do nit phone them and do not panic about the idea of a claim.

@JimKay, please read, re-read and read again the Newbies/FAQ thread near the top of this forum where everything you asked is explained. It will educate you as to where you are in this process and how to deal with the scammers and all this debt collector nonsense.
Just wait for an LoC or LBC or LBCCC (You'll find a list of abbreviations used in the thread I've advised you to study) if Plan A doesn't work. It could be up to 6 years from the date of the contravention FYI, so if you move before then, you have moved since the date, you will need to instruct the DPO of the PPC to erase your old address and make sure they have your current address. We see far too many victims of these scams on here who receive CCJs by default when they could have so easily defended it with the advice on here because they "forgot" to update their V5C.4 -
Why don’t you go back to the cinema with your PCN and cinema tickets for the date in question, ask to speak to the manager and ask them to cancel it. Explain you cannot afford to use their cinema if every visit risks an additional £100 charge.

It is often thought that if ParkingEye are using debt collectors then their contract with the landowner does not permit them to issue court claims.
It would also be an egg on the face of Parking Eye regarding the famous Supreme Court decision where it was ruled that the parking charge was set to operate the scheme.
We can accept that but thanks to the BPA, THEY DECIDED to add the great OSNER scam (ZZPS) ...... that's the extra £70 that DCBL are faking

Thanks all - so my plan for today is to
- go back into Odeon cinema, speak to manager, try to get them to cancel (I have had a ‘we can’t do anything’ response from them before via email so hope that going again in person might work)
- find out the details of the landowner and make a written complaint.

Well - update 1 - from Odeon - ‘there’s nothing we can do!’ - we don’t have an email for ParkingEye…too long ago blah blah blah
Annoying - when I asked who the landowner was - they also had no idea. The ParkingEye signs themselves just say they are working on behalf of the ‘landowner’ - fellow posters, how do you find out? is it a case of going to the council and asking? Any ideas appreciated.0 -

SOME IDEAS ON DETERMINING WHO OWNS THE LAND1. Google searches2. If a retail park, check on any signage which lists the on-site outlets3. Ask retailers on the site if there is a managing agent4. Ask retailers on the site to whom do they pay rent5. Contact the local authority and ask who pays the non-domestic/business rate for the car park (some councils have a spreadsheet on their website)6. Contact the local Valuation Office and ask if they know. They often have a website which might provide the information7. Contact The Land Registry and for around £3 they should be able to provide definitive detail8. If you haven't already done so, give us the name of the car park/site/location, we may have seen other cases there.7 -
