They claim "PARKING BEYOND BAY MARKINGS" , ?
REALLY ? The picture clearly shows that you WERE NOT beyond bay markings, the white line is part of the bay.
And the court claim signed as a statement of truth by the Elms legal representarive FAILS in that they provided proof that your car was NOT beyond bay markings and that Elms have added a fake £70 claiming the ticket was £170. This is not true
No doubt if Elms continue with this rubbish, it was result in another court spanking for VCS whereby you can claim your costs

This is my draft im going to copy and paste all of coupon mads defence template and then replace paragraph 3 with this. Also im going on holiday for 2weeks on 9th of may would i have to let the court know this somehow? The vehicle had a valid parking permit for the duration of stay and was parked within a marked bay.
The claiment states breach of contract by parking beyond the bay marker and included photos of the vehicle in question which clearly shows that it was not parked beyond the bay marker making the claiments statement of truth false.1 -
That's fine for your para 3.Also im going on holiday for 2weeks on 9th of may would i have to let the court know this somehow?Yep in your DQ N180 form, that is explained in the first 12 steps in the first post of the Template Defence thread.

Clearly you read my post of 19 March at 3:24PM.Albz00 said:Can i file my defence on the mcol website or is it better to email it like it says on the thread?
What doubts did you have about this paragraph?...KeithP said:Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.5 -
Sent off my DQ form, now iv received this shortly after, is this a sign that they are going to drop out?

Typical behaviour for VCS. Just representing themselves as Elms Legal have been used as a debt collector and then filed the claim on behalf of VCS.1

Standard VCS/Excel guff. It is not a signal that they will drop the case, read nothing into that. They may ultimately discontinue, but this letter is not part of thatPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
