PCM Claim Form time to write a defence

  • I will have another Court date I assume in the not too distant future. Different car, different location, but same Parking Co. I am currently receiving debt collection letters from Trace, but have yet to receive any letters, or CC claim form. I will await with eager anticipation. Thanks again to everyone on here that has offered advice and support. This forum and the people on here are invaluable. So thank you all!!!
  • A life lesson that you can now apply to the next claim, if they are stupid enough to try again.

Congratulations on your win. Satisfying, even if not all your points found favour with the Judge.
The person that arrived sat behind myself and my husband and he never said 1 word. He arrived in jogging bottoms and house slippers
Classy!  Gladstones very own Rab C Nesbitt, by the sound of it!

  • So husband has just received first letter from Gladstones regarding a ticket he received in 2019. I read something on this forum about same car, same location. Is there a way of getting this case thrown out based on the fact that my husband has already been to CC with PCM regarding the exact same location and same car?

Yes and no.  He can reply robustly to try to head off a court claim (not that it matters because we win in court and there's no risk).

    Search the forum for:

In a previous post by OP:-

"9.It was not until later on in the year that a letter was sent to my address stating that PCM were taking over the management of the parking.  Sometime, after that I was sent two passes one for the residential bay and one for the visitor bay."

Perhaps some enlightenment may be obtained here (or even a smile):-

"Implications of the Private Parking Code of Practice for landowners of private residential land and how the face of parking management will change."

"Parking Control Management (UK) Ltd (‘PCM’) has always welcomed the introduction of this Code and ultimately, believes it to be a good thing for the industry."

"Appeals – circumstances in which a charge must be cancelled

    The concerns
As part of the new Code of Practice, the government has outlined mitigating circumstances in which a charge must be cancelled should evidence be supplied. The three concerning points of this are:

Where a charge was issued for failing to display a permit, but the driver subsequently supplies a copy of their permit
Where a Blue Badge has not been displayed, but the driver subsequently supplies a copy of their badge
Where the vehicle has broken down
The intention of such provisions were to benefit the rule-abiding motorist who has made a minor mistake. However, the by-product of this is that paves the way for huge abuse."

Anyway, they might in future charge residents a monthly fee to provide a "Premium Service"  -  and they are not a "rogue operator" apparently.

Yes, they do, it's an acronym for Variable Rate of Moving, given the traffic jams in most large cities!
  • So as promised. Here we are again. Claim Form received 19th Jan. Will submit response via moneyclaim later next week. Same car, exact same location and same signage. Forbidding signage. No contract to enter, so should be pretty straight forward... Famous last words. Was parked on double yellow lines with disability badge this time.
