  • Noted! I emailed them stating what you had suggested (in full), though I haven't heard back. I've now been sent a letter (arrived today) from ELMS Legal, who have been charged to recover the £170. They've provided a phone number should I wish to dispute the matter further, and no email address (though I can look to find one).

Is there any standard procedure at this particular point? Thanks again and again (and again!)

Yes - as per my fuller reply.  You've bought yourself an extra 30 days, if you used all the words suggested.  And I explained why July is important, so come back when the DLUHC publish it.

Hi again, looking for some advice once more. Have received a letter from ELMS Legal that a claim has now been issued 'through the County Court Business Centre (CCBC)'. I also received the response pack from the CCBC, which looks as if it's sort of trying to be a court? It has a stamp on it with a crown saying 'the county court'. Looking at the CCBC itself online, I've found the following:

    County Court Bulk Centre (CCBC)

The (CCBC) deals with 9 out of 10 CPC cases. It operates under the name of Northampton County Court. Defences are received through the post and online. Unlike other County Courts the CCBC does not hear claims. If a claim may require a hearing a "Notice of Transfer" is issued to transfer the case to the appropriate County Court. The CCBC also manages Judgment requests and requests to issue warrants of execution.

The above paragraph is on the website moneyclaimsuk.co.uk . I'm not sure if this is actual court action or not, or what the next step in proceeding with this is, so any advice helpful thank you so much!

EDIT: - also is there any update from the DLUHC? I've seen on their website that there is currently a 'call for evidence' that is set to last until the 8th October. They've said that it would be technical in nature and seems to put off the general public from assisting them with it hah...

The CCBC is a business centre that deals with small claims court cases - well, the admin - so, if you have received a N1 claim form treat it seriously and follow the advice in the NEWBIE sticky.  Regarding the DLUHC there is a thread all about it and the call for evidence; search the forum, it is usually on page one or two.

When you receive a Claim Form from the County Court Business Centre (or Civil National Business Centre as it's now called) please tell us the Issue Date on it.

Hi - the Issue Date is 23 August 2023. Just submitted my AOS online and so now will begin preparing my defence

With a Claim Issue Date of 23rd August, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 25th September 2023 to file your Defence.

That's nearly three weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
Don't miss the deadline for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
  • Ok, thanks very much for that. Is it worth mentioning in my defence that I actually bought a ticket for 2 hours and used less than 2 hours parking? Seems that this would be the course of action in paragraph 3. I shall do this tomorrow, and would it be alright to post here for feedback?

    Thanks as always
