NPM and Gladstones

Hi all

Before I  start typing up emails for SAR etc, can anybody please confirm whether this LBC letter from our friends at Gladstones is a legitimate LBC? It will relate to various PCNs from 2018-2019. No forms attached as asking to complete online. I have my doubts as the letter asks me to pay Gladstones direct. In the past 5 years I've already received the usual ZZPS and Trace recovery letters as well as threats from Wright Hassall and QDR. I have three of these letters, all for individual cases but can't link to particular PCNs as no original PCN number referenced. Trace have already written to me at my current address so I don't know if it's the same PCNs.

Long and short of it for now is that I had around 10 PCNs within a year for parking my car at my home address, either on the street (there were no restrictions when I moved in in 2017), parking in somebody else allocated parking bay with their verbal permission or parking in my own bay with a visitors permit (one permit issued, 2 cars)

    Yes that's a Letter Before Claim.
    Deal with it as described in the second post on the NEWBIES thread.

    But they seem to be talking about an old address.

    You must - absolutely must - make sure that NPM and Gladstones have your correct address. Write to their respective Data Protection Officers to get them to correct their records.

  • Thank you. Am I right to assume the SAR is also a good opportunity to ask NPM for proof of who (as in landowner) has instructed them to act on their behalf? Can I also ask for information on when signage was erected or is this for another time?

    They won't give you landowner info and it's not part of a SAR either.  Nor is signage.

    The SAR should have gone to NPM. If you sent it to Gladrags, they must have forwarded it to their client who have responded. You may have to request the SAR directly from NPM. Their DPO email address is:  dataprotection@npmservices.co.uk
     
    NPM are obliged in law to provide you with ALL information they hold about you. Just because you don't have the PCN numbers, you give them your personal details... name, current address, any previous addresses that cover the period you may have received the PCNs, the car reg. That alone is enough for them to trawl their records and find your information.

    You should provide a copy of the V5C and maybe a redacted utility bill if they require any proof of ID. Any further request from NPM should be treated as a prevarication and frustration of your request.

    You also remind them of their 30 day obligation to respond to your SAR and that you will not hesitate to make an official complaint to the ICO if they fail to comply.

    In which case, the clock is ticking for NPM to provide all the details/correspondence/PNs they hold on you.

    Tell NPM not to be so silly.

    You are not asking for their help. You are instructing them to perform their legal obligation under the Data Protection Act 2018.

    You have given them your full name and address and provided proof of identity.

    In return you, and the Information Commissioner's Office, expect them to return all the information they hold about you, the data subject, within a calendar month of the request being made. The clock is ticking.

    You could also email Gladstones and ask for all the PCN Numbers in the case.
