    I’ve done this now and paid the £14 fee, they didn’t want to take payment and were directing me to my local court but insisted and it’s now gone through and all information emailed through to them.

    presume now it’s just a waiting game for further communication?

    You could reply to DCBLegal with your bank details for the £1798 refund.  I would, given their client has admitted there was no cause of action and the claim should never have been made, thus the Writ was also unsupported.

    Also send them a copy of your N244 and say you were forced to do that because they concocted a 'Consent Order' which has never been shown to the Defendant, let alone agreed or signed.  That draft Order was never 'by consent' and that phrase has the appearance of trying to mislead the court and to escape without paying the Defendant back.

    Tell them if your money is not returned this month, you will sue their client AND the landowner jointly until one of them pays back the £1812 the Defendant has now expended, including the £14 fee to stay/cancel the Writ of Control.

    Did you get an instant auto-acknowledgement to your N244 email?  Or did you send it whilst on the phone and the CCBC confirmed receipt?
