H signs wrong lease supplied by her solicitor. That lease sent to auctioneers. Albeit your sol didn't check it but why is H not bound by what she signed?
Yes the Hairdressers poxy solicitor is primarily to blame but that would mean the claiment skipping me and my solicitor and it dosent work like that, oh how I wish it did!
The lease that the hairdresser has is the lease with my and my wifes signature on it and not hers, her signature is on the claiments lease without our signatures,the claiment sues me because it's me he bought the shop off, the fact that the people we employed made a balls up is our fault - we hired the little sh*ts, it is up to us to put the claiment back into the position that he was in before purchase.
I have gone through all of this with my new solicitors who were once law firm of the year, even thay say the systems all wrong!0 -

How long a lease does the hairdresser have?
Can the new owner cancel her lease? If so shouldn't he do this to mitigate his own loses?
If the hairdresser is harrassing and threatening your wife and child then it's a police matter. Report it directly to the police.
3 years lease is left and the property needs nothing doing to it, the claiment cannot go wrong persuing this, he's a greedy retired businessman who no doubt sees it as a money making opportunity.
We suggested it was put back on the market when the problem was found but as I mentioned earlier no doubt a way to make even more $$$$$$$$$$$$$
Regarding the texts , I still have them, will possibly be of good use later on !0 -
Old solicitor is no longer involved, they passed the problem on to their insurer, silly thing is that the insurance dosent cover the clients they were working for.
Doesn't matter about htem passing on to the insurer. The insurer doesn't replace the solicitor, they insure any liability which arises.
If you are sued for something, but think it's someone else's fault, you can add them on as a part 20 defendant. Ask your solicitor (new one) about it....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0 -

Will enquire about the part 20 thing on Monday morning, why would my new solicitor not mention it though, they were law firm of the year once, will let you know their reply.

Ours is a panel solicitor used by our insurance company - lot of idiots , seem to be kids just out of uni, temps or just useless.

Thought some of you might be interested in an update of this fiasco, plus it may help some of you who are also having a rough time to know you are not alone.
Please remember- All this through something that was not my fault and created by my ex-solicitor:
Eventually the buyer of my shop accepted £16,500 in compensation, as I stated earlier, this was through my ex solicitors negligence of misrepresenting the sale of my shop by sending the wrong lease to the auction that was not signed by me, the business man buyer has milked this situation for all he can get, putting me into a position at first in which he would only consider recision of the contract and creating crazy solicitors fees on the way that I could do anything about, l am now also expected to pay the his solicitors fees of approx £12,500 soon.
Total £29,000
My two new solicitors fees (one for negligence claim and one for my defence) are now around £60,000 including surveys, barristers etc and are still on-going, I have had no option but to re-mortgage my home and I have now reluctantly put it up for sale, I have constantly begged, borrowed and put my family into deep debt to keep this going but once again I find myself in a position where I am struggling to carry on, I have also used my working capital, hence it has collapsed my business and I am now on Jobseekers but signing for National insurance contributions only due to 20 years of self employment.
Add to this that my Mother, Sister and Brother in law all passed away with cancer last year and you can guess I have some pretty bad days.
I have now been forced to issue proceedings against my ex solicitor, my ex solicitors insurers solicitor are not responding to emails, no doubt part of their ploy to run me out of money and to get me to give up, they know that this will cost me another £2000, these insurers really are the scum of the earth to deal with, they would not get involved at an earlier stage and simply did nothing although we have always kept them well informed of what was going on.
So to sum it up:
Due to me being put into a position where I could do absolutely nothing to get me out of it, approximately £100,000 in solicitors fees etc have been created and it is still rolling along, all of this when the shop originally sold for £144,000, it’s all gone absolutely mad.
I have tried, citizens advice, local MP, Legal aid, Legal complaints service , (who closed the case because it’s been going on for so long) and I really have no one to turn to, I don’t want to sell my home but I have no other way of raising the finance, so if anyone has any suggestions regarding organisations that I have not approached please let me and my family know, preferably before this makes the headlines on SKY news for all the wrong reasons.0 -
I am so sorry to hear all of this, the stress must be terrible. I am sorry I can not wave a magic wand, or offer any advice, but just want to say that I hope you win against these soliceters, and that the nightmare ends as soon as possible. Will you get the sols fees back if you win?
