UKPC BRENT CROSS PARENT AND BABY PCN - NOW GOT CCBC LETTER

raps

3 years ago parked in a parent and bay at Brent Cross shopping centre. I came to pick up my kids from the shopping centre who were with my husband. The kids did not finish so I returned to my car and behold I have a parking ticket. I ignored it. Kept getting the usual threatening letters.
Then received CCBC letter this week. I have done the AOS but now I am not sure whether it's worth going through it as I did not have my kids with me even though I came to pick them up and our plans changed. Even in the UKPC images I have a baby seat in the car but they still gave me a ticket. Did they monitor me on CCTV if I arrived or left with children? Can they show that in court?
any advice would appreciate it
Thanks

Your MCOL Claim History will have the definitive answer to that.

They will not have any CCTV so stop worrying about that spect. This is fully defendable and you will defeat the scamming bottom-dwellers that issued the PCN. if you follow the advice given here and read the Newbies thread near the top of this forum you can almost guarantee that a properly defended claim from the muppets at DCB Legal on behalf of their feckwit clients, UKPC, that they will fold at the last minute before this ever gets in front of a judge.
Have a look at this thread: DCB LEGAL RECORD OF PRIVATE PARKING COURT CLAIM DISCONTINUATIONS
Go read the Newbies thread and the bit about what happens ext and the steps you need to take.
Are you or are you not a "parent"? Do you think they'd issue a ticket if you were a childless aunt picking up a child? No "parent" there is there? These bottom-dwelling muppets are just trying to extort money from their victims in the belief that most will poop their pants and just pay up to avoid the hassle.
99% of these case are won or discontinued before ever reaching a courtroom. 1% are lost because the victim didn't rad the Newbies thread, didn't follow advice provided here or just gave up and paid up for the easy life.
Are you a 99 percenter or a 1 percenter?4 -
With a Claim Issue Date of 17th February, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Wednesday 22nd March 2023 to file your Defence.
That's nearly four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.2 -
B789 - thanks gives me confidence. Honestly do they not have anything Better to do?!
KeithP - thanks. Definitely will not kiss the deadline. Will work on a defence and post it here for everyone’s kind input. Then will follow the advice.1 -
Honestly do they not have anything Better to do?!Not when they can scare motorists shwitless with a county court claim. They are coining it in, with likely huge swathes of motorists coughing up some +/- £300. I'd hazard a guess that 90%+ of motorists pay up, or end up with a CCJ that will find them scurrying to pay DCB Legal. Thing is, paying them after the payment deadline given by the judge provides no material help. The CCJ after that point sees those motorists in a desperate credit state for 6 years. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

This is probably the most idiotic case from DCBL we have seen.
The pictures were taken by a UKPC goon and we all know their photographic skills .....
UKPC SCAM
https://www.dailymail.co.uk/news/article-3229165/Is-PROOF-private-parking-firms-scamming-motorists-Drivers-say-timings-photos-doctored-legally-parked-cars-issued-fines.html
The UKPC sign you have posted says Parent and Toddler parking ?
You are the Mum, your kids were inside with their Dad and you have every right to park where you did as you were collecting them
The photo goon is trying to prove there are no kids in the car but is too thick to understand that it is illegal to leave young children alone in a car.
Again, the goon then took a picture of nobody in the drivers seat ??? you were inside collecting your kids ?
If the goon was so convinced you had broken the rules, did he take pictures when finally your kids got in the car ... of course not
DCBL
The reason DCBL keep discontinuing UKPC claims is because the claims are rubbish but this one takes the biscuit for plain stupidity. This WILL get DCBL/UKPC a spanking by a judge
Again we see in the DCBL claim even more rubbish as they add fakes and claim damages. The courts do not like legals who fake a claim
We constantly see these claims signed by Yasmin Mia. If this was my case, I would be calling Yasmin Mia to court to explain the fakery to a judge.
The claim is a STATEMENT OF TRUTH
I suggest you complain to the shopping centre that UKPC are not fit to operate on their premises, goodness knows how many people are scammed like this
You now play this game with DCBL, we of course will help you.
But as eggs are eggs, DCBL has only two options, continue to court, get spanked and pay your costs or discontinue
Wonder which one they will opt for ?
Follow what the members here say and let us see any letters they send as they will try to get you to settlt before court ..... there is nothing to settle
