CCJ from 2016 fine

Hi all

I was looking at loans over the weekend and while doing a credit check, I discovered that I had a CCJ on against me that I had NO idea about.

After doing a lot of chasing, it turned out that this had been for an unpaid parking fine (that I also didn't know about) from 2016.

It's currently sitting at £369 and the contact between myself and the courts is very sparse from their end and a lot of their appeal forms come with a lot of charges that I also can't afford. 

Seeking any advice anyone can give me

    If you are on a low income, then you might qualify for help with court fees to get this CCJ removed.

    You need to act promptly now that you have discovered the CCJ. Read the bit in the Newbies thread, specifically, the second post wherein states: "HAVE YOU FOUND OUT ABOUT A CCJ (JUDGMENT FOR CLAIMANT) AND NEED IT SET ASIDE?" on what you need to now do to get the CCJ set aside. If you leave it too long, it may go badly against you. Act now.

    Still waiting on details from the Courts. Been nearly a month now

    So far I've managed to discover that;

    a) The charge is for a parking fine somewhere on a private car park in Dudley. May well be legit but I've never had a ticket or letter so I have no idea.
    b) The initial fine was in November 2016 but only went to court in May of last year

    I've asked the court to send any evidence and more importantly, which address they used to send any documentation out to me.

    If it turns out that the address is incorrect, what will that mean for me? I most definitely told the DVLA about the change of address as I had a new licence with my current address

    You cannot sit and wait.

    You must act promptly!  It is part of the requirement of the courts that the Judge expects from you! If you are going to do a N244 set aside application it should have been this month, ideally.  

    Most people get the details (of where the claim was posted) from the CCBC over the phone the same day, plus  an immediate email of the Particulars of Claim. This was easy and should have been done weeks ago.

    The PCN was never 'legit' BTW!

    Did you change the address on the V5C for your vehicle? Probably not and you should take steps to rectify that immediately as you could be "fined" by the DVLA for not having done so. When the PPC requests your information from the DVLA it is through your car registration. The PPC doesn't know who you are and so will have no idea whose information to request from the DVLA even though you updated your driving licence address.

    I don't think you "divulged" any information. You may have meant discovered. What you did not discover was that it was a "fine". By calling it that, you give some semblance of credibility to the PPC when it is definitely not deserved.
    What you discovered was that it is an invoice which you are disputing. The PPC are alleging that you are in debt to them and you are disputing this.

    So, have you read the Newbies thread yet and discovered what you need to do next? It is all divulged in that thread.

    Sold the car in question shortly after moving in to our new house in 2017 so no. New car is under Current Address

    Honestly, it's overwhelming. Hence asking for help. I'm currently filling in an N244 to have the CCJ set aside and that has opened another can of worms in terms of terminology, content and formatting. The forum going back and forth between tabs and users stating 'have you read 'x'' only to be given yet more tabs to another 'have you read this' is just a mind cluster F.

    As it is I'm gathering evidence, I've formulated a witness statement and Order. All being well it will be sent off this week

    Nobody said it would be easy. There is a steep learning curve which I'm sure you have now realised needs to be negotiated. Please continue to refer to the Newbies thread as the information is in there. You are now learning a lot of new, useful information that will help you and anyone else you care to pass it on to.

    In this case, what is the date of the PCN, what date did you move and what date did you sell the car? Let's try and establish a timeline in order to assist and see what can be used to get the CCJ set aside.

    Which PPC and which legal firm represented them?

    PCN was Nov 2016 but yet to see a letter
    Moved March 2018
    Sold car May 2018
    CCJ was filed May 2022 again, no letters. Presumably at this point everything is going to the old address

    What happened today when you rang the CCBC for everything that you need to know, and an emailed copy of the Particulars of Claim, as I advised?
