"so in theory assuming it works the same way, Tesco could/should of charged me for x days of sim service when producing the final bill after 14 days (which would of been £11.50 divided by x days?) hence why with O2 I was always charged £2-£4"

My understanding is that they would HAVE been allowed to charge you for any usage during the cooling off period, but that this would not constitute you taking out a monthly contract. My guess is that you did not actually use the sim, or at least not for a chargeable event. In that case I am not sure they are allowed to charge you anything, as you have not used the service, although perhaps a pro rata daily charge would be reasonable.
However tesco have made no charge for any usage/service during the period where you could have used the sim, and have charged you what you would have paid had you never taken out the airtime contract in the first place. This seems reasonable to me.

I'll bet tesco were wishing they had offered a cashback scheme rather than an upfront discount!

    Just to update the thread.

I have had the outstanding balance cancelled and the original sim card price of £11.50 refunded (today).

after emailing the CEO office, I got a lengthy phone call response.
Tesco admitted they got a number of things wrong in this promotion, for which he apologised for.

I had the outstanding charge cancelled and the £11.50 refunded.

it looks like the vast majority (if not everyone) has also had their outstanding balances cancelled by now
