Hi Everyone, especially those in the know.
I'm wondering if I have any case to appeal? I was recently parked at Hassocks station and as there was not a single space left, parked on a hatched area in order to make my train. I received a penalty notice on my drovers door window and was wondering if it's something I could appeal against, or should I just take the hit.
I have extensively read the Newbies thread and lots of it, but cannot find anything quite similar.
Could anybody advise me?

Are you sure it was a penalty notice and not a parking charge notice?
It doesn't really matter, it's only APCOA.
Your case is no different to any of the hundred or so threads we get here every day.
Send the appeal template in blue text you will find in the NEWBIES from the keeper. Add a one liner that since railway byelaws apply, and their NTK is not PoFA compliant, the keeper cannot be held liable so they should cancel now and save themselves money.

Thank you so much, yes it's definitely a Penalty Notice quoting section 219 of the Transport Act 2000 Railway byelaws, section 14.
I'm going to give this a try. Should I wait until day 26 and do this on line do you think? Or should I be waiting for the NTK. From what I can glean form the boards, I was going to wait until day 26.0 -
As this is a penalty notice it will time out after 6 months. So I'd wait for day 26 and thereafter do everything slowly to eat up that time.Please note, we are not a legal advice forum. Since you are a new poster you will have to wait until you have a certain number of posts to your name and a certain amount of time has passed we don't know how long). Alternatively you could send an e-mail to forumteam@moneysavingexpert.com and ask if they will adjust your post from "I was recently parked.........." to "the car was recently parked ........" You could also use the REPORT button.2

Nothing will happen and you won't be paying.
DO NOT APPEAL TO THE WINDSCREEN PCN.
YES wait for the NTK (as long as your logbook has your correct postal address because that's the one the DVLA gives out next month).
THEN wait again till day 28 in your case (the last day to appeal, on the NTK) because the whole point is (win or lose the appeal at POPLA stage) the penalty times out after 6 months.
So all your responses should be on the last day! Gets you closer to 'timed out' day.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
