First Reminder but did not receive original PCN

    Your call then as to whether you fight it or pay (this forum does not recommend paying) or take it to the inevitable court case with, I suggest a good defence of a faulty PDT situated where the sun does shine on it!
  • @Le_Kirk Thank you. Premier Park Ltd state in today's email that I have now appealed and as a gesture of goodwill they have reduced the payment to £60. It is then stated 'If you wish to contest the PCN please follow he instructions on the reverse of the charge' -- is this a different process to the appeal, do you know? I am keen to ask them to reduce the £60 to £20. Is this request something they are likely to challenge?
  • @Le_Kirk also, to add, I'm not sure the machine was faulty as such, it just allowed me to enter only three letters and issued a receipt.

It is then stated 'If you wish to contest the PCN please follow he instructions on the reverse of the charge' -- is this a different process to the appeal, do you know? I am keen to ask them to reduce the £60 to £20. Is this request something they are likely to challenge?
    Write back to them (email) to ask why a ticket was issued by the machine before the complete VRM was entered. Tell them this is a keying error caused by their technology and the charge should be cancelled - if they are correctly following the BPA Code of Practice. Should they fail to deal with this satisfactorily, you will refer the case to the BPA. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Follow the advice just posted by @Umkomaas and of course the PDT is faulty; no one would design a machine that asked for a complete VRM and then only print three characters - unless specifically requested by a PPC but surely not!.  If you read around the other threads on the forum you will find many instances of PDTs that only print three letters/numbers or some that print codes such as "Q" or "P"

    Just send them a copy of the ticket and offer £20 (major keying error rate) or they must send a POPLA Code.

    The First Reminder dated 19/01/2023 states the reason the PCN was issued was because 'Whole Period of Parking Not Paid For'. I followed advice of this Forum and raised an appeal via online procedure with Premier Park, stating that I never received the original PCN dated 15/12/2022. I received an email reply from Premier Park from a 'no reply' email address stating the reason the PCN was issued was "because the vehicle was parked in XXXX car park for a period of XXXX with no payment for the full, correct registration paid for'. It appears that the reason for issue on the original and reminder PCN don't exactly corelate, does this matter or is it just a case of semantics?

    Either way, I found the parking receipt which confirmed that I did pay for the whole amount of parking, but had mistyped my vehicle veg. As I had no direct email address for Premier Park, I emailed a helpful lady at the BPA who kindly forwarded my email to Premier Park requesting for a copy of the original PCN. Premier Park then emailed me again, with a snotty response, attaching a copy of the first reminder PCN, not the original, and have extended (for the second time) the reduced payment period. At this stage they are not aware that I have the parking receipt.

    I am aware that I could request that the fee be reduced to £20 for a mistype of vehicle reg. But are there grounds to contest the charge with Premier Park given what I have mentioned above?

    To clarify my query -- are there grounds for me to contest the PCN based on my parking receipt confirming payment for the full period of parking when Premier Park's reason for PCN issued in the First Reminder is 'Whole Period of Parking Not Paid For', and there being no mention of 'with no payment for the full, correct registration paid for'?

    Nope, it's the same thing, effectively.

    You should have told PP about the keying error and sent them a copy of the ticket weeks ago when I advised you how to play this a month back.

    Have you got a POPLA Code?
